ORDER :
THE COURT MADE THE FOLLOWING ORDER :-The petitioner apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 498(A) I.P.C.and Section 4 of Dowry Prohibition Act and Section 4 of the Tamil NaduProhibition of Harassment of Women Act and hence, seeks anticipatory bail.
It is submitted by the learned counsel for the petitioner that the petitioner is innocent and he has not committed any offence and prays for anticipatory bail in favour of the petitioner.
It is submitted by the learned Additional Public Prosecutor(Crl. Side) that only petition enquiry is pending. He further submitted that the matter was referred for mediation, but mediation was not materialised between the parties.
Considering the facts and circumstances of the case and also considering the fact that only petition enquiry is pending and mediation was not materialised between the parties, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial https://hcservices.ecourts.gov.in/hcservices/ Magistrate No.I, Thoothukudi, Thoothukudi District and on executing abond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learnedMagistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required. The petitionershall comply with the condition stipulated under Section 438 Cr.P.C.Scrupulously.
