W.P.(MD)No.21648 of 2022consequently directing the 2nd Respondent to disburse all the retirement benefits including DCRG and pension to the Petitioner along with interest.2.Heard Ms.Rohini for M/S.T.Lajapathi Roy Associates learned counsel for the petitioner and Mr.M.Ajmalkhan, learned Additional Advocate General assisted by Mr.T.Cibi Chakraborthy, learned counsel for the respondents 1 and 2 and Mr.F.Deepak, learned Special Government Pleader for the third respondent.3.This Court, vide order dated 23.06.2025, had passed the following order:-“Heard Ms.Rohini, learned counsel for M/s.Lajapathi Roy Associates, appearing for the Petitioner, Mr.M.Ajmalkhan, learned Additional Advocate General, assisted by Mr.T.Cibi Chakraborthy, learned counsel for the Respondents 1 & 2 and Mr.F.Deepak, learned Special Government Pleader for the 3rd Respondent.2.This Writ Petition has been filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari and Mandamus, challenging the order in Ref.No: Estt-II/t2/7482/2021 on the file of the 2nd Respondent dated 09.06.2021, insofar as non-payment of terminal benefits is concerned and consequently 3/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022directing the 2nd Respondent to disburse all the retirement benefits including DCRG and pension to the Petitioner along with interest.3.This Court vide order dated 18.06.2025 passed the following order:“3. The co-ordinate bench of this Court vide order dated 14.11.2024 passed the following order:“The petitioner, with a grievance that he was not paid with terminal benefits, has filed this writ petition.2.When the writ petition is taken up for hearing, learned Standing Counsel for the respondents University submitted that pursuant to a vigilance enquiry, the terminal benefits of the petitioner was withheld. In this regard, the University has appointed a Three Member Committee and the Committee has submitted its report. This report is likely to be placed before the Syndicate of the University on 28.11.2024 and that the Syndicate may even consider the petitioner's request for terminal benefit, depending upon the enquiry report. Therefore, he prayed for an adjournment.Considering this submission made by the learned Standing Counsel, list this writ 4/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022petition on 05.12.2024, 'for orders'.”4. Thereafter, the co-ordinate bench of this Court vide order dated 05.12.2024 passed the following order: “The petitioner, a retired Registrar of Madurai Kamaraj University, Madurai has approached this Court that his terminal benefits have not been settled to him, even after his retirement in the year 2021, in view of clearance from the Directorate of Vigilance and Anticorruption Department, Virudhunagar.2.Today(05.12.2024), when this writ petition is taken up for hearing, the learned counsel appearing for the respondent University submits that the eligibility of this petitioner for his terminal benefits have been considered by a Sub Committee and a report of the Sub Committee has been filed on 07.12.2023. Since the post of Vice Chancellor is vacant in the University, Syndicate meeting has not been conducted upto 25.11.2024 and it was conducted only on 25.11.2024, wherein, a resolution has been passed by the Syndicate to get clarifications from the Law Secretary. 5/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022Accordingly a communication has been sent to the Department of Law and awaiting to receive an opinion from the Law Department, based on which, further course of action would be taken.3.This Court considered the submissions made by the learned counsel for the respondent University.4.The petitioner, a retired employee of Madurai Kamaraj University has approached this Court in the year 2022 that he was not settled with the terminal benefits even though he was allowed to retire on 09.06.2021. The grievance of this petitioner is that even after filing of this writ petition, the terminal benefits have not yet been settled to him.5.In view of the above, this Court directs the second respondent University to appraise the orders of this Court before the Secretary, Law Department, pursue their proposal and to get orders within a period of four weeks from the date of receipt of a copy of this order. The Secretary, Law Department Secretariat, Chennai shall consider the proposal of the second 6/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022respondent University and take a decision on their recommendations, taking note of the fact that an employee, who has retired from service in the year 2021 has not been settled with the retirement benefits for more than three years.List on 21.01.2025.”5. When the matter is being taken up today, Mr.M.Ajmal Khan, learned Additional Advocate General, assisted by Mr.F.Deepak, learned Special Government Pleader, appearing for the 3rd Respondent, submits that pursuant to the direction issued by the coordinate bench of this Court dated 05.12.2024, the Secretary, Law Department, Secretariat, Chennai, has received the paper book from the Respondent University and, after going through the entire record, the Law Secretary took a decision on 12.05.2025. The copy of the said decision is taken on record and the same is reproduced hereunder:“It is seen that Thiru V.Chinniah, formerly Registrar of Madurai Kamaraj University has been permitted to retire and relieved from the services of the University with effect from 9th June 2021 A.N on superannuation, subject to 7/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022clearance from Directorate of Vigilance and Anti-corruption, Virudhunagar. (vide letter of the University in Estt-II/T2/7482/2021/dt.09.06.2021). 2. It is further seen from the note of Higher Education department that DVAC has concluded that the allegation against Tvl. Koodalingam, R.Baskaran formerly Joint Director of Collegiate Education and Thiru R.Chinniah formerly Registrar of the University, is substantiated. Based on the above DVAC Report, the Director of Collegiate Education has conducted an enquiry in which it has been held that the allegation against Tvl. Koodalingam and Baskaran former Joint Directors are not proved. That apart, the Registrar, Madurai Kamaraj University was directed to place the report of the DV&AC before the syndicate of Madurai Kamaraj University and to take appropriate action on the report of DV&AC. The Vice-Chancellor of the Madurai Kamaraj University had constituted an Enquiry Committee to enquire the allegation against Thiru V.Chinniah. But, the 8/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022Enquiry report of Directorate of Collegiate Education has been placed before the Enquiry Committee and the Enquiry Committee without framing the charge memo against the said Thiru V.Chinniah has resolved to place matter before the Syndicate on 25.11.2024 wherein it has been decided to refer the matter to Law department.3. From the above sequence of events, it is evident that the Enquiry Committee constituted to enquire the allegation against the said Thiru V. Chinniah had not at all framed any charges and instead of framing charges and conducting enquiry it diverted the issue by placing the enquiry report of the Directorate of Collegiate Education before the Syndicate which relates to the Joint Directors of the Collegiate Education. Thus, the issue has been diluted by the enquiry Committee for the reasons best known to it and the fact that boiled down in the above situation is the no charges have been framed against the said Thiru V. Chinniah who retired on 9/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 20225.6.2021, so far.4. Under the above circumstances, the file has been referred for remarks on the question of sanction of provisional pension and DCRG to the said individual. This has to be considered as per the provisions of Tamil Nadu Pension Rules, 1978 which is made applicable to the officers and other employees of the said University. In this connection, it may be stated that as per sub-clause (ii) of clause (b) of sub-rule (2) of rule 9 of the Tamil Nadu Pension Rules, 1978 the department proceedings, if not instituted while the Government servant was in service whether before his retirement or during his re-employment shall not be in respect of any event which took place more than four years before such institution. In this case, the incident of allegation took place in the years 2017 and 2018. (as seen from the note of Higher Education in para 11 on p.7 ante). Higher Education department may ensure this period of occurrence from records. Therefore the limitation period of 4 years specified in 10/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022the above said Tamil Nadu Pension Rules is over now and no charges can be framed against the said Thiru V.Chinniah at this juncture, since the limitation period of four years for limitation of departmental proceedings from the date of occurrence has expired. Consequently, all terminal benefits and pension has to be sanctioned to the above individual. Higher Education department may consult Finance department also in this regard.”6. Mr.M.Ajmal Khan, the learned Additional Advocate General, further submits that, as per the decision taken by the Law Secretary, it was found that charges had not been framed against the petitioner, and allegations against other persons, namely Koodalingam and Baskaran, former Joint Directors, were also not substantiated. The order also notes that, according to sub-clause (ii) of clause (b) of sub-rule (2) of Rule 9 of the Tamil Nadu Pension Rules, 1978, departmental proceedings, if not initiated during the Government servant’s service (whether before retirement or during re-employment), cannot be instituted for events that occurred more than four years prior to such initiation. In this case, the alleged 11/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022incident occurred in the year 2017 and 2018.7. The learned Additional Advocate General submits that, as per the applicable Rules, the limitation period of four years has already expired. The cause of action arose in the years 2017-2018, and even after the date of retirement of the Petitioner i.e., on 09.06.2021, the limitation period has expired. Accordingly, the Law Secretary has correctly concluded that the Petitioner was not involved in the controversy, and the allegations against him have not been substantiated. The Law Secretary has directed the release of the Petitioner’s entire terminal benefits, pension, and other dues, with instructions to the Higher Education and Finance Departments to take the necessary actions. A copy of the order has also been provided to the Respondent University for taking appropriate decision for disbursement of retiral and terminal benefits, pension, and other monetary benefits to the Petitioner, as the proposal was given by the Respondent University to the Law Secretary for its decision and opinion. The learned Additional Advocate General submits that the amount should be paid to the Petitioner without further delay.8. This Court inquires from the learned counsel, Mr.Cibi Chakraborthy, appearing for the Respondent University, whether the amount has been disbursed to 12/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022the Petitioner in compliance with the decision taken by the Secretary, Law Department, Secretariat, Chennai, dated 12.05.2025. He submits that he has no instructions in this regard.9. Ms.Rohini, learned counsel for M/s. Lajapathi Roy Associates, appearing for the petitioner, submits that she has inquired with the petitioner, who stated that not a single penny has been paid to him. She also submits that the petitioner has been running from pillar to post to get the money he rightfully earned through his service to the University. More than three years have passed since the present writ petition was filed in the year 2022, and the Respondent University continue to delay the matter on one pretext or another. She further submits that the petitioner is struggling due to old age, various health issues, and substantial medical expenses, and is currently facing severe financial distress, struggling to meet his family's basic needs in the absence of any monetary benefits from the Respondent University since his retirement.10. Thus, the learned counsel prays that this Court take serious action against the Respondent University authorities, particularly the Registrar and members of the Committee who are currently managing the Vice Chancellor's office, as the Vice Chancellor position has been vacant for over a year. She also 13/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022submits that the Respondent University authorities have deliberately harassed the petitioner with malafide intentions for 7 years, withholding payments even after his retirement in the year 2021. She prays that this Court direct the Respondent University to pay interest at the rate of 9% per annum on the outstanding dues from the date of retirement till the actual payment is made, considering the delay caused by the Respondent University.11. This Court, after hearing the submissions of the learned counsel for the parties and perusing the orders passed by the co-ordinate bench of this Court dated 05.12.2024 and the decision taken by the Secretary, Law Department, Secretariat, Chennai dated 12.05.2025, is of the view that the stand taken by the Respondent University is highly unsatisfactory. It appears that they are merely harassing the Petitioner for his genuine dues. The Writ Petition, filed in the year 2022, has been pending before this Court for the past 3 years. In accordance with the principles of natural justice and equity, a person who has served the Department for a long period should receive their rewards and retiral dues, including pension, GPF, gratuity, and medical funds, forthwith without further delay. Any departmental proceedings or technicalities should also be resolved as expeditiously as possible.14/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 202212. In the present case, the conduct of the Respondent University does not seem proper. The unnecessary delay in this matter reveals arbitrariness and malafide intentions on the part of the Respondents towards the Petitioner. It seems they are attempting to settle some undisclosed or personal issues with the Petitioner, the reasons for which are known only to the Respondent University. 13. Therefore, this Court deems it appropriate to direct the Registrar of Madurai Kamaraj University, Palkalai Nagar, Madurai – 625 021, along with the Committee members of the Respondent University (who are currently managing the office due to the Vice Chancellor position remaining vacant for over a year), to appear in person before this Court on 20.06.2025. They shall justify their conduct as to why, despite the decision taken by the Secretary, Law Department, Secretariat, Chennai, dated 12.05.2025, based on their proposal, the disbursement of retirement dues, including pension, GPF, gratuity, and medical funds, has not been done yet. In this regard, if payment has been made, details shall be provided. Further, they are directed to file their personal affidavits before this Court by 20.06.2025, to justify their conduct.15/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 202214. The prayer sought by the learned counsel for the Petitioner regarding payment of interest at the rate of 9% on the outstanding dues, in light of the delay caused by the Respondent University, also appears justified. Thus, the Respondent University is directed to make payment of simple interest at the rate of 9% per annum on the outstanding dues from the date of retirement till the actual payment is made.15. Put up this case on 20.06.2025 before this Court “For Further Orders”. 16. Let a copy of this order be furnished to Mr.T.Cibi Chakraborthy, learned counsel for the Respondent University and Mr.F.Deepak, learned Special Government Pleader for their necessary compliance and information to the Respondents.4. This Court vide order dated 20.06.2025 passed the following order:“2. In pursuance of the order dated 18.06.2025 passed by this Court, a Writ Miscellaneous Petition in W.M.P.(MD)No.12829 of 2025 has been filed to dispense with the personal appearance of one E.Sundaravalli, who is presently serving as the Convenor of Madurai Kamaraj 16/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022University, Palkalai Nagar, Madurai and also as Commissioner of Collegiate Education Department, Chennai, on 20.06.2025. Accordingly, the personal appearance of the petitioner in W.M.P.(MD)No.12829 of 2025 on 20.06.2025, is dispensed with for the present.3. Mr.M.Ajmal Khan, learned Additional Advocate General assisted by Mr.Cibi Chakraborthy, appearing for Respondent University, requests this Court to grant time to comply with the order dated 18.06.2025 passed by this Court in the present writ petition.4. On the request made by the learned Additional Advocate General and the application moved to dispense with personal appearance for the reasons stated in paragraphs 6 and 7, the case is adjourned today. 5. All the Respondents along with E.Sundaravalli, who is presently serving as the Convenor of Madurai Kamaraj University, Palkalai Nagar, Madurai, are directed to appear in person before this Court as per the direction issued by this Court dated 18.06.2025, on 23.06.2025 and in this regard, the Respondents are directed to file their affidavit of compliance on 23.06.2025.17/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 20226. Put up this case on 23.06.2025 before this Court “For Further Orders”. 7. Let a copy of this order be furnished to Mr.M.Ajmal Khan, learned Additional Advocate General, Mr.T.Cibi Chakraborthy, learned counsel for the Respondent University and Mr.F.Deepak, learned Special Government Pleader for their necessary compliance and information to the Respondents.”5. In compliance with the orders passed by this Court dated 20.06.2025, Mrs.Sundaravalli, presently serving as Convenor of Madurai Kamaraj University, Palkalai Nagar, Madurai, and also serving as Commissioner of the Collegiate Education Department, Chennai, along with Mr.M.Ramakrishnan and Mr.B.Mayilvaganan, presently serving as Registrar and member of the Convenor Committee, respectively, are present in person before this Court. Mrs.Sundaravalli has submitted an affidavit of compliance, which is hereby taken on record.6. Mrs.Sundaravalli, who is presently serving as Convenor of Madurai Kamaraj University and also serving as Commissioner of Collegiate Education Department, Chennai, has stated in paragraphs 6 and 7 of the compliance affidavit that all efforts have been made to settle the petitioner's retirement dues. She produced a letter dated 21.06.2025, which states that pursuant to the Court's direction on 18.06.2025, and the Government's letter 18/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022No.8254414/H-1/2025-2 dated 19.06.2025, the University has sanctioned and disbursed the petitioner's retirement benefits and provisional pension (as per Syndicate resolution dated 24.05.2019) arrears, with effect from 01.07.2021. The details of the payments are as follows:(i) DCRG (100%): An amount of Rs. 20,00,000/- via Cheque No. 432271 dated 20.06.2025.(ii) Commutation: An amount of Rs. 35,75,796/- via Cheque No. 432273 dated 20.06.2025.(iii) Provisional Pension at 90% for the month of July 2021 (as per the Syndicate resolution dated 24.05.2019): An amount of Rs. 82,400/- via Cheque No. 432272 dated 20.06.2025.(iv) 90% Provisional Pension arrears for the period from 01.08.2021 to 30.04.2025 (as per the Syndicate resolution dated 24.05.2019): An amount of Rs. 47,43,500/- via Cheque No. 432274 dated 20.06.2025.(v) Leave Encashment Salary (OL & UEL on PA) (Gross Rs. 2,177,961 less IT & Cess Rs. 585,925): The net amount of Rs. 15,92,036/- (after deduction of income tax of Rs. 5,85,925/-) via Cheque No. 780612 dated 20.06.2025.The scanned copy of the said letter is reproduced hereunder:19/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 202220/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 202221/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 20227. Mr.M.Ajmal Khan, learned Additional Advocate General, produced the five original cheques before this Court. After perusing the original cheques for the amounts mentioned, this Court acknowledges that five cheques to the tune of Rs.1,19,93,732/- (Rupees One Crore Nineteen Lakh Ninety Three Thousand Seven Hundred Thirty Two only) out of the total sum of Rs.1,25,79,657/- (Rupees One Crore Twenty Five Lakh Seventy Nine Thousand Six Hundred Fifty Seven only) which includes the TDS of Rs.5,85,925/-, are being handed over to the Petitioner, Dr.V.Chinniah, through his advocate, Ms.Rohini, learned counsel, today in this Court. A photocopy of the aforementioned cheques is being taken on record, and the Petitioner has also made an endorsement on the aforesaid cheques. 8. Thus, it was agreed by the learned counsel for the petitioner and Respondents that after deducting TDS of Rs.5,85,925/- the petitioner received a total amount of Rs.1,19,93,732/- (Rupees One Crore Nineteen Lakh Ninety Three Thousand Seven Hundred Thirty Two only) through the aforementioned five cheques in original. 9. Mrs.Sundaravalli, presently serving as Convenor of Madurai Kamaraj University, Palkalai Nagar, Madurai, and also serving as Commissioner of the Collegiate Education Department, Chennai, who is present in person before this Court 22/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022today, further submitted that the remaining amount will be paid after clearance from the audit department within three weeks from today, without fail. She also assured that the revision of pay will be finalized within the same period. Furthermore, she undertook to oversee the matter State-wide, ensuring that no one else suffers further delays in receiving pension and other retirement benefits. Instructions to this effect have already been issued to her subordinates and the department.10. Mrs.Sundaravalli, further assured the Court that she will comply with the direction issued by this Court vide order dated 18.06.2025, regarding payment of simple interest at the rate of 9% per annum on the outstanding dues from the date of retirement till the actual payment. She confirmed that the remaining amount, including the interest, will be paid to the Petitioner on or before the next date fixed by this Court. She further assured the Court that pension and arrears for May 2025 and subsequent months will be paid promptly to the Petitioner.11. In view of the assurance made by Mrs.Sundaravalli, presently serving as Convenor of Madurai Kamaraj University, Palkalai Nagar, Madurai, and also serving as Commissioner of the Collegiate Education Department, Chennai, this Court is satisfied with the efforts taken by the Directorate of Education and her prompt action in settling the petitioner's retirement dues. As prayed for by Mrs.Sundaravalli and Mr.M.Ajmal 23/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022Khan, learned Additional Advocate General assisted by Cibi Chakraborthy, this Court grants a period of three weeks to settle all the petitioner's dues, as assured and file an affidavit of compliance in this regard.12. The personal appearance of Mrs.Sundaravalli, Convenor of Madurai Kamaraj University and Commissioner of the Collegiate Education Department, Chennai, along with Mr.M.Ramakrishnan, Registrar, and Mr.B.Mayilvaganan, member of the Convenor Committee, is exempted by this Court until further orders.13. Put up this case on 24.07.2025 before this Court “for further orders”.14. Let a copy of this order be furnished to Mr.M.Ajmal Khan, learned Additional Advocate General, Mr.T.Cibi Chakraborthy, learned counsel for the Respondent University and Mr.F.Deepak, learned Special Government Pleader for their necessary compliance and information to the Respondents.”4.Today, when the matter is taken up, Mr.M.Ajmalkhan, learned Additional Advocate General assisted by Mr.T.Cibi Chakraborthy, learned counsel for the respondents 1 and 2, in compliance of the order passed by 24/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022this Court in the present writ petition, dated 23.06.2025, has produced a copy of the proceedings issued by the Registrar i/c, Madurai Kamaraj University, Palkalai Nagar, Madurai 625 021, dated 23.07.2025 and submits that the direction issued by this Court in W.P.(MD) No.21648 of 2022, dated 23.06.2025 has been fully complied with and the remaining amount payable by the respondents has been paid to the petitioner without any default and as of now, no amount is due to the petitioner in respect of the claim made by the petitioner in the present writ petition. Thus, he submits that in view of the compliance of the order of this Court dated 23.06.2025 and in view of the proceedings issued by the Registrar i/c, Madurai Kamaraj University, Palkalai Nagar, Madurai 625 021, dated 23.07.2025, now, there is no cause of action exists in the present writ petition and accordingly, the same is liable to be disposed of in the above terms. 5.A copy of the proceedings issued by the Registrar i/c, Madurai Kamaraj University, Palkalai Nagar, Madurai 625 021, dated 23.07.2025, has been produced before this Court, which is now taken on record and a 25/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022copy of the same has also been given to the learned counsel for the petitioner. 6.Ms.Rohini for M/S.T.Lajapathi Roy Associates learned counsel for the petitioner submits that she has received a copy of the proceedings issued by the Registrar i/c, Madurai Kamaraj University, Palkalai Nagar, Madurai 625 021, dated 23.07.2025 and after consulting with her client, who is present in person before this Court today, she submits that the entire amount towards retiral benefits payable by the respondents has been paid to the petitioner and as of now, no amount is due to the petitioner. Thus, she has no objection, if the present writ petition is disposed of, in view of the above terms. However, she prays this Court that she may be given liberty to file a fresh Writ Petition before the competent Court of law, seeking interest for the belated payment made to the petitioner. 7.Accordingly, in view of the submissions made by the learned counsels for the parties and after perusal of the direction issued by this Court in W.P.(MD) No.21648 of 2022, dated 23.06.2025 and the proceedings issued by the Registrar i/c, Madurai Kamaraj University, Palkalai Nagar, 26/29 https://www.mhc.tn.gov.in/judis W.P.(MD)No.21648 of 2022Madurai 625 021, dated 23.07.2025 and also considering the fact that the entire retirement benefits has already been paid to the petitioner, this Court deems it appropriate that no useful purpose will be served in keeping this Writ Petition pending before this Court, as the direction issued by this Court in W.P.(MD) No.21648 of 2022, dated 23.06.2025 has been fully complied with by the respondents and the petitioner has also received the entire retirement benefits from the respondents. 8.Accordingly, the Writ Petition is finally disposed of with liberty to the petitioner to raise the issue with regard to payment of interest for the belated payment made to the petitioner before the competent Court of law, if he so desires. No costs.
