The auction is said to have taken place on 18.04.2018. The confirmation of sale was made on 19.04.2018 and thereafter, sale certificate was issued in favour of the petitioner on 11.05.2018 which was registered as Doc No.2230/2018 before the second respondent/Sub 2/12 https://www.mhc.tn.gov.in/judis W.P.(MD) No.20289 of 2025Registrar, Thiruverumbur Sub Registration Office, Trichy District. In the description of the property that was purchased by the petitioner in the sale certificate and the sale deed are almost identical. The sale certificate dated 11.05.2018 states as follows:a) All that piece and parcel of vacant land situated at Pappakurichi Village, Trichy Taluk, Trichy District comprised in Survey No.205/1A2, land measuring an extent of 6750 sq.ft or 627.09 sq.mr(out of 9750 sq.ft or hectare 0.09.0 ares) and bounded on the North by:Urumu Dhanalakshmi Collage Play ground CompoSouth by : Land belonging to Kothandapani and SubramaniEast by: Pitchai's land and Compound wallWest by: Land in (b) propertymeasuringNorth to South on the Eastern side: 75 feetNorth to South on the Western side: 75 feetEast to West on the Northern side 90 feetEast to West on the Southern side: 90 feetand situated within the Registration Sub District of Tiruverumbur and Registration District of Trichy.3/12 https://www.mhc.tn.gov.in/judis W.P.(MD) No.20289 of 2025(Covered under Sale Deed Document No.8028/2009 dated 31.12.2009)b) All that piece and parcel of vacant land situated at Pappakurichi Village, Trichy Taluk, Trichy District comprised in Survey No.205/1A2, land measuring an extent of 3000 Sq.ft or 278.71 sq.mtr (out of 9750 Sq.ft or hectare 0.09.0 ares) and bounded on theNorth by: Urumu Dhanalakshmi Collage Play ground Compound WallSouth by: Land belonging to Kothandapani and Subramani landsEast by: Land in (a) propertyWest by: RoadmeasuringNorth to South on the Eastern side: 75 feetNorth to South on the Western side: 75 feetEast to West on the Northern side : 40 feetEast to West on the Southern side: 40 feetand situated within the Registration Sub District of Tiruverumbur and Registration District of Trichy.a) and b) totally measuring 9570 Sq.ft(Covered under Sale Deed Document No. 8029/2009 dated 31.12.2009)3. In the sale certificate, specifically it has been stated that both the properties are covered by Sale Doc.No.8029/2009 dated 31.12.2009 which is a sale deed in favour of the petitioner's father/the borrower who has proceeded 4/12 https://www.mhc.tn.gov.in/judis W.P.(MD) No.20289 of 2025under the provisions of the SARFAESI Act. 4. In the sale certificate, a reference has been made to new S.No.250/1 and a reference has made to patta No.2820. After the petitioner purchased the property and registered the sale deed, the petitioner appears to have approached the revenue authorities for mutation of the records. The petitioner was also issued with patta No.4013. However, the description of the survey number has been altered from 205/1A2 (Old S.No.250/1 to 237/2). This is based on the proceedings of the Tahsildar dated 03.11.2023 is long after the sale certificate dated 11.05.2018 and the registration of the sale certificate on 18.05.2018 vide registered Doc.No.2230/2018. The petitioner has referred to another document of the Tahsildar dated 12.06.2025 in his proceeding bearing Na.Ka.No.AA1-60/2025 wherein again the description of the property has been given which is similar to the description in the sale certificate and the registered sale certificate. The specific grievance of the petitioner is that the petitioner is unable to deal with the property as the survey number has changed from Old No.205/1A2 to 237/2.6.This is opposed by the learned counsel for the first respondent Bank stating that even that have taken place long after the issuance of the sale 6/12 https://www.mhc.tn.gov.in/judis W.P.(MD) No.20289 of 2025certificate on 11.05.2018 and its registration on 18.05.2018 registered as Doc.No.2203/2018 would not entitle the petitioner remedy by way of writ petition or a mandamus to direct the first respondent to execute a rectification deed by incorporating the new S.No.237/2 as per the proceeding of the Tahsildar dated 12.06.2025 and the patta No.4013 issued to the petitioner pursuant to the proceedings of the Tahsildar dated 03.11.2023. 7. The learned counsel appearing for the official respondent on the other hand would submit that if the petitioner gives a representation, same will be considered and disposed of. I have considered the submission of the learned counsel for the petitioner and respondents.9. On perusing the documents that have been produced before this 8/12 https://www.mhc.tn.gov.in/judis W.P.(MD) No.20289 of 2025Court, I am of the view the relief sought for in the present writ petition cannot be granted merely because there is an alteration of the survey numbers subsequently in the year 2023 pursuant to the proceedings of the Tahsildar on 03.11.2023 wherein the description of the property has been altered by changing the survey number from 250/1A2 to 237/2. 10. Merely because the survey number is altered pursuant to the above said proceedings, ipso facto would not mean the property is not marketable. The records are official records wherein it has been clearly stated as to how the survey No.250 in the sale certificate that was registered on 18.05.2018 has been altered to 237/2. Therefore, this writ petition is liable to be dismissed and accordingly, dismissed.
