The impugned notices have been issued pursuant to the directions issued by the National Green Tribunal, Southern Region, Chennai, vide order dated 24.07.2024, passed in O.A.No.221 of 2024. If any grievance _______________Page 15 of 19 https://www.mhc.tn.gov.in/judis W.P.(MD) Nos.20173 of 2024 etc. batchexists, the petitioners concerned have to approach the National Green Tribunal or in the alternate, they have to submit their explanation to the impugned notices. Contrary, such disputed issues cannot be decided in a writ jurisdiction under Article 226 of the Constitution of India. Brick kilns causing environmental damages is the issue considered by the National Green Tribunal in the said O.A.No.221 of 2024. That being so, the petitioners concerned are at liberty to submit their explanation to the impugned notices or in the alternate, to approach the National Green Tribunal for redressal of their grievance, as the case may be.3. At this juncture, learned counsel for the petitioners in W.P.(MD) No.20173 of 2025 would submit that the petitioners have submitted applications to the authority concerned seeking renewal of licence.4. Even in such circumstances, the Pollution Control Board has to conduct inspection and issue necessary no objection certificate for the purpose of considering the case of the applicants. In all these cases, High Court cannot decide the issue involved in the case on hand and it requires elaborate inspection, field inspection etc., and no objection certificate is to be _______________Page 16 of 19 https://www.mhc.tn.gov.in/judis W.P.(MD) Nos.20173 of 2024 etc. batchobtained from the Pollution Control Board and other competent authorities. More so, in the present case, the National Green Tribunal has passed an order, which has resulted in issuance of the impugned notices. Consequently, connected miscellaneous petitions are closed.
