Side) ORDERThe present Criminal Original Petition has been filed by A1 in S.T.C.No.4620 of 2025 on the file of the Judicial Magistrate Court No.6, Madurai, seeking to quash the charge sheet wherein the petitioner is charged with the offences under Sections 75 of the Tamil Nadu City Police Act, 1888.
A perusal of the charge sheet reveals that the petitioner along with other accused persons at about 01.00 p.m on 26.01.2025 was using obscene words as against the general public while standing on the road.
According to the learned counsel appearing for the petitioner, a false case has been foisted by the police as against the petitioner.
Heard the learned counsel appearing for the petitioner and perused the materials available on record.
It could be seen from the charge sheet that the petitioner is said to 2/5 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD).No.13614 of 2026have abused the general public using obscene words. However, there is no allegation whatsoever that it was likely to breach public peace. The allegation is vague and does not warrant for continuation of criminal proceedings as against the petitioner herein.
Considering the above said facts, the charge sheet in S.T.C.No.4620 of 2025 on the file of the Judicial Magistrate Court No.6, Madurai, is hereby quashed.
