The petitioner has filed this Writ Petition for a Mandamus to direct the first respondent to issue Trade Licence to the petitioner pursuant to the application filed on 09.01.2024 without insisting No Objection Certificate from the respondents 2 and 3.3. The respondents 2 and 3 are the District Officer of the Fire and Rescue Service and Pollution Control Board, respectively.2/8 https://www.mhc.tn.gov.in/judis W.P.(MD) No. 19051 of 20254. It appears that one Mariathangam has lodged a complaint against the petitioner regarding the furniture shop and saw mill, which are run by the petitioner. 5. It appears that the said Mariathangam had also approached this Court in W.P.(MD)No.4215 of 2025, pursuant to her representation, dated 23.12.2024 against the petitioner. By an order, dated 18.02.2025, this Court had disposed of the said Writ Petition with the following observations:“6. It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon him to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, non-consideration of the representation by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking its extraordinary powers under Article 226 of the Constitution of India and direct them to consider the same within a stipulated time.6. In the light of the above observations, there shall be a direction to the respondents 1, 4 and 5 herein to consider the petitioner's representation dated 23.12.2024, on its own merits and pass appropriate orders in accordance with law, after giving due opportunity to the petitioner, the eighth respondent, as well as all other persons, who may be interested in the subject matter, within a period of four weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents 1, 4 and 5 to consider the same on its own merits.3/8 https://www.mhc.tn.gov.in/judis W.P.(MD) No. 19051 of 20257. In the background, a notice was issued to the petitioner, wherein a reference has been made to the complaint of the said Mariathangam. The petitioner also appears to have given an undertaking, wherein the petitioner has stated that the petitioner will not use any heavy machinery for cutting the woods. However, despite the undertaking, it appears that the said Mariathangam has been given repeated complaints to the respondents, pursuant to which a notice, dated 18.11.2024 was issued to the petitioner and the petitioner has also approached the respondents 2 and 3. Considering the fact that there is a dispute between the petitioner and the said Mariathangam, who has secured an order, dated 18.02.2025 in W.P.(MD) No.4215 of 2025 and considering the fact that the petitioner has not impleaded the said Mariathangam in the present Writ Petition, at whose behest the application filed by the petitioner for Trade Licence has been stalled, I am of the view that the 5/8 https://www.mhc.tn.gov.in/judis W.P.(MD) No. 19051 of 2025petitioner’s representation for the Trade Licence can be considered and disposed of by the first respondent, after hearing the objection of the said Mariathangam as has been contended earlier. 9.
