According to the petitioner, every year in the tamil month of Vaikasi, they used to celebrate the temple festival. This year also, the 2/10 https://www.mhc.tn.gov.in/judis W.P.(MD)No.14420 of 2025elders of the village have decided to celebrate the temple festival from 27.05.2025 to 29.05.2025 at Sri Mariyamman Kovil and as per the village custom, they tied 'Kappu', which is symbolic beginning of festival celebration. The 5th respondent is the resident of Ariya Kovilpatti Village, which is near to their village. Sri Mariyamman Kovil belongs to the petitioner's village and they used to collect 'Thalaikattu Vari' only from their village residents and other village residents are not entitled to pay 'Thalaikattu Vari'. The second respondent arranged a peace committee meeting on 08.05.2025. In the peace committee meeting, they have clearly informed that they will receive 'Thalaikattu Vari' from all the village residents irrespective of any community and as the 5th respondent not belonged to their community, they will not receive 'Thalaikattu Vari' from the 5th respondent. However, the 2nd respondent passed the impugned order dated 14.05.2025 stating that they should not to celebrate 'Sri Mariyamman Kovil' festival from 27.05.2025 to 29.05.2025, which was constrained the petitioner to file this writ petition. 3/10 https://www.mhc.tn.gov.in/judis W.P.(MD)No.14420 of 20253. The learned counsel for the 5th respondent appeared through Video Conference, but, due to poor internet connectivity, his arguments could not be heard. 6. It appears that a peace committee meeting was held on 14.05.2025, since the petitioner refused to receive 'Thalaikattu Vari' from the 5th respondent. Originally, the said 'Sri Mariyamman Kovil' is situated in a promboke land and it belongs to the general public. It was newly constructed during the year 2022, after receiving donation from all community people. The 2nd respondent, during the peace committee meeting, requested the petitioner to collect the tax from Naidu community people. The petitioner, who belongs to Vanniyar community, refused to receive the tax from Naidu community. 7. The learned counsel for the petitioner, during the course of arguments, submitted that they are ready to receive money from the 5th respondent and his community people, but, they would give receipts by mentioning as 'donation' and not as 'Thalaikattu vari'. 4/10 https://www.mhc.tn.gov.in/judis W.P.(MD)No.14420 of 20258. Further, it is brought to the notice of this Court about the order dated 15.05.2025 passed in W.P.(MD)No.14141 of 2025 filed by the 5th respondent, seeking a direction to receive Thalaikattu Vari from him and his community people, like other villagers without any discrimination and ensure the participation of the petitioner and his community people to the temple festival of Mariamman Temple situated at Kallupatti Hamlet, Rajakkapatti Village, Dindigul East, Dindigul, scheduled to be held on 27.05.2025 to 29.05.2025. In the above writ petition, it was informed by the learned Additional Advocate General appearing for the official respondents that the representation of the petitioner (5th respondent herein) was considered and it was decided to receive 'vari' from the petitioner (5th respondent herein) and his community people vide proceedings dated 14.05.2025 in Na.Ka.No.2542/2025/A3.
