Respondent(Crime No.111 of 2008, on thefile of Kodaikanal Police Station,Dindigul District)For Petitioner:Mr.R.SankarasubbuFor Respondent:Mr.A.ThiruvadikumarAdditional Public Prosecutor3/9 https://www.mhc.tn.gov.in/judis Crl.A.(MD) No.478 of 2021C O M M O N O R D E R[Order of the Court was made by M.DHANDAPANI, J.]The petitioners herein were implicated as accused in S.C.No.339 of 2018,on the file of the learned Principal District and Sessions Judge, Dindigul, for theoffence punishable under Sections 148, 121(A), 124(A), 153(A), 153(B), 307 r/w 149I.P.C., and Section 25(1)(A), 27 of the Arms Act, 1959 and Sections 3, 4 and 5 of theExplosive Substances Act, 1908 and Section 13(1)(a), 13(1)(b), 18 of Unlawful activities(Prevention) Act, 1967. 2. After trial, by Judgment dated 19.01.2021, the petitioners herein wereacquitted from the charges levelled against them. Aggrieved by the said acquittal,the State has preferred Crl.A.(MD) No.478 of 2021.3. It is seen that when the said criminal appeal came up for final hearingon 21.04.2025, none appeared for the petitioners and therefore, this Court issuedwarrant to secure the petitioners in Crl.M.P.(MD) No.5974 of 2025 and produce thembefore the learned Principal District and Sessions Judge, Dindigul, for committingthem to prison pending disposal of the above criminal appeal. Pursuant to the saidorder, the petitioners in Crl.M.P.(MD) No.5974 of 2025 have filed the said criminalmiscellaneous petition seeking to recall the warrant issued against them.4. However, in the meanwhile, Surya @ Ranjith @ Sekar was arrested on4/9 https://www.mhc.tn.gov.in/judis Crl.A.(MD) No.478 of 202128.04.2025; Senthil @ Kannan @ Kumar @ Minnal was arrested on 25.04.2025,Neelamegam @ Kathir @ Vinayak and Bagathsingh @ Sugadev appeared throughtheir counsel, Kavya @ Reena Choice Mary @ Meenakshi and Shenbagavalli @Sivasakthi were arrested on 25.04.2025.5. In view of the same, Crl.M.P.(MD) No.5974 of 2025 is dismissed asinfructuous as against Surya @ Ranjith @ Sekar, Senthil @ Kannan @ Kumar @Minnal, Kavya @ Reena Choice Mary @ Meenakshi and Shenbagavalli @ Sivasakthias they have been arrested and committed to prison and insofar as Neelamegam @Kathir @ Vinayak and Bagathsingh @ Sugadev are concerned, since they haverepresented through their counsel, the warrant dated 21.04.2025, issued against them,is hereby recalled.6. Subsequent to the arrest, the said Surya @ Ranjith @ Sekar, Senthil @Kannan @ Kumar @ Minnal, Kavya @ Reena Choice Mary @ Meenakshi andShenbagavalli @ Sivasakthi have filed Crl.M.P.(MD) Nos.6481, 6482 of 2025, 6483 of2025 and 6484 of 2025 respectively seeking to enlarge them on bail pending disposalof the above criminal appeal.7. Learned counsel appearing for the petitioners submitted that thepetitioners in Crl.M.P.(MD) Nos.6481, 6482 of 2025, 6483 of 2025 and 6484 of 2025were originally acquitted from the charges by the Trial Court and challenging the5/9 https://www.mhc.tn.gov.in/judis Crl.A.(MD) No.478 of 2021same, the State has preferred the above appeal and when the said appeal came up forfinal hearing, since none appeared on behalf of the petitioners, warrant was issued asagainst them by this Court and pursuant to the same, the petitioners in Crl.M.P.(MD)Nos.6481, 6482 of 2025, 6483 of 2025 and 6484 of 2025 were arrested and committed toprison. However, learned counsel for the petitioners submitted that the petitionerswill co-operate for the final disposal of the above appeal and seeks for bail.8. Heard the learned Additional Public Prosecutor for the respondent.9. Taking into consideration the facts and circumstances of the case andthe above submission that the petitioners will co-operate for the final disposal of theappeal, this Court is inclined to enlarge the petitioners on bail.10. Accordingly,(i)The petitioners in Crl.M.P.(MD) Nos.6481, 6482 of 2025,6483 of 2025 and 6484 of 2025 are directed to be enlargedon bail on executing a bond for Rs.25,000/- (Rupeestwenty five thousand only) each with two sureties, ofwhom, one should be a blood related surety, each for a likesum to the satisfaction of the learned Principal District andSessions Judge, Dindigul.6/9 https://www.mhc.tn.gov.in/judis Crl.A.(MD) No.478 of 2021(ii)The sureties shall affix their photographs and Left ThumbImpression in the surety bond and the Trial Court mayobtain a copy of their Aadhar card or Bank passbook toensure their identity.(iii) The petitioners shall appear before the learned Trial Judgeat 10.30 a.m., on the first working day of every week untilfurther orders.(iv)It is made clear that if anyone of the petitioners is not co-operating for the final disposal of the above criminalappeal and violates the above conditions imposed by thisCourt, the warrant issued by this Court will be restored.11.
