Heard Mr.T.Pon Ramkumar, learned counsel appearing for the Petitioner and Mr.D.Sadiq Raja, learned Additional Government Pleader, who accepts notice on behalf of the Respondents. Therefore, no further notice is required to be issued to the Respondents.3. The Contempt Petition has been filed for non compliance of the judgment and order passed by the Writ Court in W.P.(MD)No.18916 of 2021 and connected batch cases dated 02.09.2022 and the learned Single Judge of the Writ Court disposed of the said Writ Petition along with 2/9 https://www.mhc.tn.gov.in/judis Contempt Petition (MD)No.1055 of 2023connected batch cases in the following terms:“Accordingly, the impugned order dated 07.06.2021, on the file of the first respondent is quashed. Consequently, there shall be a direction to the concerned Educational Authorities to forthwith pass orders, approving the appointment of M.Shenbagam, to the post of Secondary Grade Teacher, in the petitioner school with effect from 01.08.2013, together with all service and monetary benefits, within a period of four (4) weeks from the date of receipt of a copy of this order.”4.Mr.T.Pon Ramkumar, learned counsel for the petitioner submits that challenging the judgment and order passed in W.P.(MD) No.18916 of 2021, dated 02.09.2022, the respondents have preferred appeal in W.A.(MD) No.1172 of 2024, before this Court, which was dismissed by the Hon'ble Division Bench of this Court, vide judgment and order, dated 23.07.2024. 5.When the matter was taken up for hearing on 11.08.2025, this Court passed the following order:Mr.D.Sadiq Raja, learned Additional Government 3/9 https://www.mhc.tn.gov.in/judis Contempt Petition (MD)No.1055 of 2023Pleader for the respondents submits that the entire monetary benefits will be paid by the respondents in the account of the petitioner within 48 hours without fail and prays for an adjournment in this regard. 2.Mr.T.Pon Ramkumar, learned counsel for the petitioner has no objection to the aforesaid prayer made by the learned Additional Government Pleader for the respondents.3.Accordingly, as prayed for by the learned Additional Government Pleader for the respondents, adjournment is allowed.4.Put up this case on 13.08.2025 'for orders' before this Court. 6.Today, when the matter is taken up, Mr.D.Sadiq Raja, learned Additional Government Pleader for the respondents has filed an affidavit of compliance of the respondents, dated 13.08.2025, annexing a copy of the order passed by the first respondent, dated 01.04.2025, in which it has been stated that the direction issued by the Writ Court in W.P.(MD) No.18916 of 2021, dated 22.09.2022 has been fully complied with and the entire monetary benefits have been paid to the petitioner and no amount is due to the petitioner. 4/9 https://www.mhc.tn.gov.in/judis Contempt Petition (MD)No.1055 of 20237.In paragraph No.8 of the compliance affidavit, the aforesaid fact has been clearly stated, which is reproduced hereunder:-“8.In obedience to the order made in W.P.(MD).No.18916 of 2021, dated 22.09.2022 the District Educational Officer (Elementary), Madurai, vide proceedings made in Pa.Mu.No.671/Aa4/2022, dated 01.04.2025, has positively considered the claim of the petitioner. Thus the order passed by this Hon'ble Court has been complied with in letter and spirit thereby approved the appointment of the writ petitioner w.e.f. 01.08.2013. The monetary benefits to the tune of Rs.40,72,939/- (Rupees Nine Hundred and Thirty Nine Only) would be credited today ie., (13.08.2025).”8.A copy of the compliance affidavit filed by the respondents, dated 13.08.2025 has been produced before this Court, which is now taken on record and a copy of the same has also been given to the learned counsel for the petitioner. 9.Thus, the learned Additional Government Pleader for the respondents submits that the respondents may be discharged from the present contempt proceedings, as the judgment and order of the Hon'ble 5/9 https://www.mhc.tn.gov.in/judis Contempt Petition (MD)No.1055 of 2023Writ Court in W.P.(MD).No.18916 of 2021 dated 22.09.2022, has been fully complied with by the second respondent, vide order dated 01.04.2025 and the present Contempt Petition may also be disposed of, accordingly. 10.Mr.T.Pon Ramkumar, learned counsel for the petitioner submits that he has received a copy of the compliance affidavit filed by the respondents, dated 13.08.2025, annexing a copy of the Order passed by the first respondent dated 01.04.2025 and has no objection, if the respondents are discharged from the contempt proceedings, as the judgment and order of the Writ Court dated 22.09.2022 has been complied with by the respondents, vide order dated 01.04.2025. He further submits that the entire monetary benefits due to the petitioner have already been paid to the petitioner and as of now, no amount is due to the petitioner. 11.Accordingly, in view of the submissions made by the learned counsels for the parties and after perusal of the judgment and order made in W.P.(MD).No. 18916 of 2021 dated 22.09.2022 and the compliance affidavit filed by the respondents, dated 13.08.2025, annexing a copy of the order passed by the first respondent, dated 01.04.2025 and also 6/9 https://www.mhc.tn.gov.in/judis Contempt Petition (MD)No.1055 of 2023considering the fact that the entire monetary benefits have already been paid to the petitioner, this Court is satisfied that the direction issued by the Writ Court in W.P.(MD) No.18916 of 2021, dated 22.09.2022 has been fully complied with by the respondents and thus, no useful purpose would be served in continuing the present contempt proceedings against the respondents. Accordingly, the respondents are discharged from the present contempt proceedings. 12. In view of the above, the Contempt Petition is finally disposed of. No costs.
