Heard Mr.M.Saravanakumar, learned counsel appearing for the petitioner and Mr.S.Kameshwaran, learned Government Advocate, who takes notice on behalf of the respondents. 2 https://www.mhc.tn.gov.in/judis W.P(MD)No.8635 of 20263. When the matter came up for hearing today, the learned Government Advocate, appearing on behalf of the respondents would submit that while conducting an enquiry regarding the lands, they found that in some of the survey numbers, a Patta had been issued to landless poor persons. Therefore, no objection has been raised so far.

Be that as it may, when the petitioner has made an application and subsequently followed it up with a representation, the same shall be considered, and an order should be passed in accordance with the law.

Even with reference to the said defects or any other impediments, the petitioner can also be heard by way of a personal hearing. If the petitioner rectifies the defect or satisfies the authority, then the same shall be considered. However, if the land is found to be unsuitable, an order in writing must still be passed.

Let the aforesaid excise shall be completed as expeditiously as possible, in any event not later than six weeks from the date of receipt of the web copy of the order; iii. Needless to mention that the said time is given in view of the notification of the general election and the moral code of conduct in force; iv.
