Heard the learned counsel on either side.3. The impugned calculation memo dated 23.04.2021 is set aside in the light of the fact that the same has been prepared without even issuing notices to the petitioners and without hearing them.4. However, the learned counsel appearing for the 1st respondent would submit that the petitioners have not even paid the admitted amount till date. 5. Therefore, while remanding the matter back to the 1st respondent to reconsider the enhancement of the lease amount, the respondents shall issue notice to the petitioners, hear them and thereafter pass appropriate orders on merits and in accordance with law. However, enquiry will be enhanced only if the arrears of the admitted lease amount are paid by the petitioners. 4/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.9378 of 2021 and etc., batch 6. It is needless to state that if the admitted lease amount is not paid by the petitioners, steps can be taken by the corporation to evict the petitioners. The petitioners are directed to make appropriate payment within a period of eight (8) weeks from the date of receipt of a copy of this order. On receipt of the same, the respondents are directed to permit the petitioners to run their shops. 7. With the above directions, the writ petition stands allowed. No costs.
