By the proceedings of the third respondent dated 30.06.2006, the petitioners and some other persons were appointed in the post of Junior Assistant cum Typist with effect from 23.02.2006. Admittedly, the said appointment was conditional appointment, and the condition is that, within a period of probation, the appointees has to obtain certificate in typewriting. Since the petitioners did not comply the condition, the third respondent recommended vide their order dated 21.06.2017, to appoint the petitioners in another post qua Conservancy Inspector.3.While sending the proposal, the third respondent considered the interim order passed by this Court in M.P(MD)No.3 of 2013 in W.P(MD)No.5149 of 2013 dated 03.04.2013. In the above writ petition, these petitioners have challenged the order of the first respondent's G.O.Ms.No.129 dated 14.03.2013, by and in which the request for the exemptions from typewriting certificate was rejected. For ready reference, the interim order dated 03.04.2013, as extracted in the third respondent proposal dated 21.06.2017 annexed in the typed-set, is extracted hereunder:“In any event, it is stated even in the afore-said Government order, the petitioner's are in employment for decades. Hence, the petitioners cannot be terminated. Further, at the same time, they cannot be employed also as Typist. Aggrieved with the order in W.P(MD)No.5149 of 2013, dated 13.12.2018, one of the petitioner therein preferred an appeal in W.A(MD)No.1466 of 2018, wherein the Hon'ble Division Bench has passed the following order:9/18 https://www.mhc.tn.gov.in/judis W.A.(MD)Nos.2712, 2795 and 2790 of 2025“When the matter came up for hearing, the learned counsel appearing for the third respondent would submit that the proposal sent by the third respondent in Na.Ka.No.C3/7249/2007 dated 21.06.2017 is pending consideration before the respondent No.2.2.In such view of the matter, the (*) second respondent the Commissioner Municipal Administration is directed to take a call on the proposal of the third respondent dated 21.06.2017 to the post of conservancy Inspector within a period of six weeks from the date of receipt of a copy of this order.3.With the above direction, this Writ Appeal stands disposed of. No costs.”Therefore, it is amply clear that, not withstanding the order of the learned single Judge, the Hon'ble Division Bench has given an accord to consider the proposal dated 21.06.2017.7.While looking at the recruitment rules qua the Tamil Nadu Municipal Corporation General Service Rules, 1996, the method of recruitment for Conservancy Inspector is by transfer from its holder of 10/18 https://www.mhc.tn.gov.in/judis W.A.(MD)Nos.2712, 2795 and 2790 of 2025the post of Junior Assistant cum Typist. Here, the third respondent was very much conscious that the petitioners did not qualify the typewriting course, however, though Conservancy Inspector post which also requires the very typist qualification, the petitioners were proposed to be recruited by transfer to the post of conservancy Inspector. To put it otherwise, for a person to be appointed as a Conservancy Inspector, he ought to have been a Junior Assistant cum Typist. Therefore, the very fact of the petitioners being considered for the post of Conservancy Inspector, covertly and overtly vindicate that the petitioners' eligibility at the feeder category post. 8.Therefore, harmonious consideration of the first respondent rejection letter dated 14.03.2013 and the third respondent's proposal dated 21.06.2017, in the back drop of the Division Bench order, in W.A(MD)No.1466 of 2018 (which is extracted herein above), would emerge that the second respondent, who passed an order on 16.12.2019, has accepted the proposal of the third respondent in G.O.Ms.No.167, to appoint Junior Assistant cum Typist (feeder category post) who did not 11/18 https://www.mhc.tn.gov.in/judis W.A.(MD)Nos.2712, 2795 and 2790 of 2025possess typewriting qualification, to the post of Conservancy Inspector. 9.For ready reference, this Court deems it appropriate to depict the scanned image of G.O.Ms.No.167 dated 16.12.2019:12/18 https://www.mhc.tn.gov.in/judis W.A.(MD)Nos.2712, 2795 and 2790 of 202513/18 https://www.mhc.tn.gov.in/judis W.A.(MD)Nos.2712, 2795 and 2790 of 202514/18 https://www.mhc.tn.gov.in/judis W.A.(MD)Nos.2712, 2795 and 2790 of 202510.In the above G.O., the respondents have relaxed the Typewriting qualification while appointing them as Conservancy Inspectors based upon the proposal dated 21.06.2017 of the third respondent. Therefore, the relaxation of educational qualification of Typewriting to the Conservancy Inspector will enure to the feeder category post of Junior Assistant cum Typist also, otherwise the very appointment of Conservancy Inspector by transfer from Junior Assistant cum Typist become meaningless. 11.Therefore, when a person was appointed during 2006 in the post of Junior Assistant cum typist, which requires pass in Higher Secondary and typewriting, though did not pass the typewriting examination, considered for the post of Conservancy Inspector, in the year 2019, would only imply the relaxation of condition for possessing typewriting certificate even in the feeder category. Therefore, this Court is of the firm view that having continuously treating the petitioners as a Junior Assistants cum Typists from 2006 to 2019 and considered them for a post of Conservancy Inspector, during 2019 cannot deny the increment 15/18 https://www.mhc.tn.gov.in/judis W.A.(MD)Nos.2712, 2795 and 2790 of 2025in the feeder cadre. 12.Therefore, the appellant cannot be deprived from getting increment by referring to the conditions stipulated in the earlier appointment letter which was latter relaxed in the G.O.Ms.No.167 dated 16.12.2019. In view of the same, the order of the learned single Judge is liable to be interfered with by allowing the writ petition.13.In the result, these Writ Appeals are allowed As a sequitur prayer sought for in the writ petitions are allowed as prayed for.
