Heard the learned counsel appearing on either side.3. In all these writ petitions, the writ petitioners are relying upon title documents/pattas/joint pattas/pattas standing in the name of the predecessor-in-title/pattas standing in the name of the family members, etc. and they have submitted the applications after paying necessary charges, seeking survey of the subject property and for demarcation of boundaries. 4. In some of the cases, in the light of certain objections 6/13 https://www.mhc.tn.gov.in/judis Writ Petition Nos.44948, 45041, 45212 & 45237 of 2025raised by the rival parties/neighbours, they have also sought police protection, at the time of conducting the survey.5. In the considered view of this Court, since the issues involved are common in all these writ petitions, these writ petitions can be disposed of in the following terms:(a)It is left open to the concerned Tahsildar/Surveyor to take note of the title documents relied upon by the parties and the pattas/joint pattas that are also relied upon in some of the cases.(b)The Tahsildar/Surveyor concerned shall act upon the online application submitted by the respective petitioners and shall conduct survey in the subject property, in line with the title documents and the pattas that are relied upon by the respective parties and complete the survey, within a period of eight (8) weeks from the date of receipt of a copy of this 7/13 https://www.mhc.tn.gov.in/judis Writ Petition Nos.44948, 45041, 45212 & 45237 of 2025order.(c)Wherever there are rival claimants, unless they have obtained any restraint order from any Civil Court, such survey shall be conducted in their presence.(d)Wherever the Tahsildar/Surveyor is of the opinion that they would require police aid for the purpose of conducting the survey in a peaceful manner, the concerned jurisdictional police shall grant police protection at the time of conducting the survey.(e)It is made clear that in each case where the parties are seeking survey of the respective subject properties, they should have made an online application and if such online application has not been made, the respective petitioners are directed to make the online application and on receipt of the same, the Tahsildar/Surveyor concerned shall act upon the same, in the light of the above directions issued by this 8/13 https://www.mhc.tn.gov.in/judis Writ Petition Nos.44948, 45041, 45212 & 45237 of 2025Court.(f)It is made clear that the directions issued by this Court will pertain only for conducting the survey over the subject property and it will not entitle any parties to fence or put up a compound wall around the properties, more particularly, in cases where there are rival claims.All these writ petitions are disposed of in the above terms.
