I heard Mr Nanthakumar, learned counsel for the revision petitioner in CRP Nos. 5096 & 5098 of 2025, Mr Bharathkumar, learned counsel for the revision petitioner in CRP.No. 5312/2025, and Mr Anirudh Krishnan for the contesting respondent in all the revision petitions.3.These revisions have been filed challenging the orders passed by the Execution Court, ordering attachment of the properties belonging to the revision petitioners. The primordial submission of the revision petitioners in all these revisions is that the respondents have given an undertaking that they would not press for orders in the execution petition, and the statement was made before the court, and a memo was filed before the executing court. Notwithstanding the same, the executing court has now proceeded to order attachment.4. Mr Anirudh Krishnan, learned counsel for the respondent, has fairly submitted that it is a fact that such an undertaking was given; however, it was limited only till the next hearing of the CMA. But at the same time he would also concede that, though the CMA has been appearing in the list, the matter has not been reached. 5. In light of the above, the learned counsel for the respondent states that he has no serious objection to the order of attachment passed in the execution __________Page 5 of 7 https://www.mhc.tn.gov.in/judis CRP No. 5312 of 2025court being set aside, and the further proceedings in the execution court shall be deferred until the CMA is taken up for hearing to enable the respective petitioner to obtain the interim orders in the CMA.6. Recording the same, these civil revision petitions are disposed of. No cost. It is made clear that in the meantime the revision petitions also shall not take advantage of the execution petition being deferred, and they shall maintain status quo with regard to the subject matter of the immovable properties.
