The case of the petitioner is that the petitioner institution was granted recognition to run the B.Ed course with an annual intake of 100 students from the academic year 2007-2008. The respondent University has also granted continuous affiliation till the academic year 2024-2025. The application for grant of continuous affiliation from the year 2025-2026 upto 2027-2028 was made by the petitioner along with the prescribed fees on 23.10.2024. This application was kept pending by the respondent.3. In the meantime, admission of students for the academic year 2025-2026 was made and the respondent has also issued notification for uploading the students details and payment of registration fees. The grievance of the petitioner is that the respondent University did not pass any orders on the application for grant of continuous affiliation nor is the University permitting the petitioner to have access to upload the students details admitted for the academic year 2025-2026. It is under these circumstances, the present writ petition came to be filed before this Court. https://www.mhc.tn.gov.in/judis WP No. 39295 of 20254. The respondent has filed a counter affidavit and the relevant portions are extracted hereunder:-“4. I state that it is true that the Petitioner was granted Continuation of Provisional Affiliation (CPA) for the academic year from 2022-2023 to 2024-2025 as per the proceedings of this University dated 25.11.2022. A careful perusal of the Continuation of Provisional Affiliation (CPA) dated 25.11.2022 makes it very clear that the Petitioner should submit the Application seeking Continuation of Provisional Affiliation (CPA) for the next three academic years by way of application on or before 31.10.2024. Thus, the Petitioner is aware of the same and submitted his application for grant of Continuation of Provisional Affiliation for academic year 2025-2026 to 2027-2028 on 23.10.2024. In the said CPA order, as many as seven deficiencies were pointed out and the Petitioner college was mandated to rectify the same and report compliance of the rectification deficiencies within a six months period from the date of the issuance of the order dated 25.11.2022.5. I state that after the submission of the application, the Inspection Committee was constituted on 22.07.2025 and the inspection was also conducted on 24.07.2025 in the petitioner’s institution. The inspection report states that during inspection, documents were not produced and accordingly, the Inspection team had not recommended for grant of Continuation of Provisional Affiliation to the Petitioner College. Further, the deficient documents required for grant of Continuation of Provisional Affiliation were called for from the Petitioner College so that the deficiencies may be rectified enabling the Petitioner College to avail Continuous Provisional Affiliation for the block of academic years 2025-2026 to 2027-2028, which the petitioner did not do and the same cannot be entertained by the Respondent University.6. I specifically deny the allegations made in Para 5 of the Affidavit that the compliance report enclosing the documents except order of staff approval was submitted on 15.09.2025. It is relevant to mention that the communication dated 15.09.2025, addressed by the Petitioner college was in fact received by the Respondent University, however, it is very pertinent to mention https://www.mhc.tn.gov.in/judis WP No. 39295 of 2025that the said communication though recites the documents concerning deficiency were enclosed, no such documents were in fact enclosed with the said communication. The said communication was left at the Tapal section of the University without any documents being enclosed with it. Thus, the averments of the Petitioner are hereby strictly denied. Had any documents concerning the rectification of the deficiencies been actually enclosed along with the said communication, the same would have been produced by the Petitioner college in the present Writ Petition.”5. Heard the learned Senior Counsel appearing on behalf of the petitioner and the learned Standing Counsel appearing on behalf of the respondent University.6. It is clear from the counter affidavit filed by the respondent and also from the submissions made by the learned Standing Counsel appearing on behalf of the respondent University that what was received by the respondent was only the communication dated 15.09.2025 addressed by the petitioner institution and according to the respondent University, none of the documents that are relied upon by the petitioner were enclosed along with the application. In view of the same, the respondent was not in a position to verify as to whether the deficiencies have been rectified by the petitioner.7. The learned Senior Counsel appearing on behalf of the petitioner submitted that the petitioner institution has once again submitted all the relevant documents on 22.10.2025 to the respondent University and since the respondent https://www.mhc.tn.gov.in/judis WP No. 39295 of 2025University has taken the above stand in the counter affidavit, the petitioner institution will once again submit all the documents to the respondent University. It was submitted that a direction may be given to the respondent University to act upon the application and the documents relied upon by the petitioner and to grant the continuous affiliation as sought for by the petitioner institution in their application.8. Taking into consideration the facts and circumstances of the case and considering the stand taken by the respondent, there shall be a direction to the petitioner to once again submit all the necessary documents that have been relied upon by the petitioner when the application was submitted. This process shall be completed by the petitioner within a period of one week from today. On receipt of the same, the respondent shall act upon the application and satisfy themselves as to whether the petitioner has rectified all the deficiencies and proceed to issue necessary proceedings with respect to the grant of continuous affiliation, within a period of three weeks from the date of receipt of the documents from the petitioner institution.9. In the meantime, it is brought to the notice of this Court that the respondent has to open the portal to enable the petitioner institution to submit the list of students for getting approval. It is further brought to the notice of this Court that the last date was on 03.11.2025. In order to ensure that the students https://www.mhc.tn.gov.in/judis WP No. 39295 of 2025are not kept in a limbo, there shall be a direction to the respondent to enable the portal to be accessed by the petitioner in order to submit the particulars of the students. Ultimately, everything will be subject to the final decision to be taken by the respondent University.10. This writ petition is disposed of in the above terms. Consequently, the connected writ miscellaneous petition is closed.
