Rajendiran Additional Government PleaderCOMMON ORDERSince the issue involved in these writ petitions pertains to the de-sealing of the premises and the subject matter is inter-connected, both writ petitions are disposed of by way of this common order.2. It is stated that the petitioner in W.P. No.39099 of 2025 established a Trust by name M/s.Yuthira Charitable Trust for the welfare of children in need of special care and for psychiatric patients. With the said object, she approached one Kuppuraj, father of the petitioner in W.P. No.39075 of 2025, requesting to let out his property for running the special school on a rental basis. Accordingly, a licence agreement was entered into between them, and the school has been functioning for the past two years without any adverse remarks. While things stood thus, in May 2025, one of the special children died in a suspicious manner in the said premises. Subsequently, without issuing any prior notice, the respondents 2 and 3 in W.P. No.39099 of 2025 sealed the premises.3/11 https://www.mhc.tn.gov.in/judis W.P. Nos.39075 and 39099 of 20253. It is the grievance of the petitioner in W.P. No.39099 of 2025 that various records and materials relating to the functioning of the special school have been kept inside the sealed premises. Hence, she submitted a representation dated 13.09.2025 to the respondents 2 and 3 seeking de-sealing of the premises, but no action has been taken till date. Therefore, W.P. No.39099 of 2025 has been filed seeking a direction to de-seal the property. 4. Insofar as the petitioner in W.P. No.39075 of 2025 is concerned, he is engaged in cultivation of saffron. It is his grievance that due to the sealing of the entire premises, including his father’s property, which is adjacent to his land, he is unable to carry out his agricultural operations, resulting in severe financial loss. Hence, he submitted a representation dated 29.07.2025 to the respondents seeking de-sealing and permission to access his portion of the property.5. Learned counsel for the petitioner in W.P. No.39099 of 2025 submitted that the petitioner now intends to vacate the said premises and hand over possession to the licensor/owner, who is the father of the petitioner in W.P. No.39075 of 2025. Therefore, he sought that the prayer may be moulded, and 4/11 https://www.mhc.tn.gov.in/judis W.P. Nos.39075 and 39099 of 2025the respondents be directed to allow the petitioner to take back the records and belongings pertaining to the special school.6. Learned Additional Government Pleader appearing for respondents submitted that as against the incident of death in the said Special School, a case was registered on the file of V Additional District Judge, Coimbatore in S.C. No.306 of 2025 and the same is in investigation stage. Therefore, he prayed for issuance of appropriate directions in the above regard. 7. In view of the above submissions, this Court moulds the relief and issues the following directions :i) Respondents 2 and 3 in W.P. No.39099 of 2025 are directed to de-seal the portion of the land belonging to the petitioner, so as to enable free ingress and egress to his property. ii) Respondents 2 and 3 in W.P. No.39099 of 2025 are further directed to permit the petitioner in W.P. No.39099 of 2025 to enter the premises and take back the records, materials, and belongings pertaining to the special school without any further hindrance. However, it is made clear that any records or materials related to the investigation in S.C. No.306 of 2025 on the file of the V Additional District Judge, Coimbatore, shall be kept in safe custody by the 5/11 https://www.mhc.tn.gov.in/judis W.P.
