Mr.D.R.Arun Kumar, learned Standing Counsel, accepts notice on behalf of the respondents in all the writ petitions. With the consent of the learned counsel for the parties, this writ petition is taken up for final disposal at the stage of admission itself.Page No.3 of 8 https://www.mhc.tn.gov.in/judis W.P.Nos.39679, 39687 & 39688 of 20253. The case of the petitioners is that they have participated in the tender called for by the 2nd respondent vide different notification for procurement of AAA Weasel conductors. Since the L1 tenderers could not supply the entire quantity required by the respondents, the 2nd respondent issued purchase orders dated 20.08.2025 to 32 successful bidders to procure varying quantities of AAA conductors offered by them. When the petitioners were taking steps to deliver the AAA conductor to the respondents after having procured raw materials for manufacturing of the said product, the 2nd respondent has passed the respective impugned orders, all dated 15.09.2025, cancelling the purchase orders issued in favour of the petitioners. Challenging the same, the petitioners have filed the above writ petitions before this Court.4. The learned Senior Counsel appearing for the petitioners submits that without issuing any show cause notice to the petitioners, the 2nd respondent has passed the impugned orders against the petitioners. Further, the 2nd respondent ought to have granted adequate opportunity to the petitioners and has gravely erred in bi-passing the principles of natural justice. Hence, he submitted that the impugned orders passed by the 2nd respondent are wholly unsustainable and the same may be set Page No.4 of 8 https://www.mhc.tn.gov.in/judis W.P.Nos.39679, 39687 & 39688 of 2025aside and remanded to the 2nd respondent for fresh consideration.5. The learned Standing Counsel appearing for the respondents has no objection for the above order being passed by this Court.6. Admittedly, without affording any opportunity to the petitioners, the 2nd respondent has passed the impugned orders against the petitioners, cancelling the purchase orders issued in favour of the petitioners, which are in clear violation of principles of natural justice. On the sole ground, this Court is inclined to set aside the impugned orders passed by the 2nd respondent.7. Accordingly, the respective impugned orders dated 15.09.2025 are set aside and the matter is remanded to the 2nd respondent for fresh consideration. While re-considering the same, the 2nd respondent shall issue a show cause notice to the petitioners, if so advised, and thereafter pass appropriate orders, on merits and in accordance with law, as expeditiously as possible.Page No.5 of 8 https://www.mhc.tn.gov.in/judis W.P.Nos.39679, 39687 & 39688 of 20258.
