Writ Petition No.419 of 2025 is filed praying for issuance of a Writ of Certiorarified Mandamus to call for the records relating to the impugned order passed by first respondent in his proceedings in Se.Mu.Na.Ka.No.5720/2024/A6, dated 02.01.2025, quash the same as illegal, mala-fide, arbitrary and coupled with bias and consequently direct the first respondent to retin the petitioner's committee and hereditary archakas appointment in the Temple of Shree Boomi Neela Sametha Shree Karivaradharajaperumal Thirukoil at Thirumalainaickenpalayam, Coimbatore District, within a time stipulated by this Court.4. In the factual background of these Writ Petitions, it is to be noted that there is a serious dispute with regard to the maintenance of the management and administration of the Temple (Arulmighu Shree Boomi Neela Sametha Shree Karivaradharaja Perumal Temple) in between the petitioners. These petitioners have filed these Writ Petitions challenging the appointment of Fit Person, Page No. 5 / 8 https://www.mhc.tn.gov.in/judis W.P.Nos.36827 of 2025, 39740 of 2024 and 419 of 2025Archakar and to direct the petitioner in W.P.No.36827 of 2025 to hand over the charge of the Temple to the Fit Person. While entertaining the Writ Petitions, this Court granted interim order in W.P.No.36827 of 2025. However, the learned counel for the petitioner in W.P.No.39740 of 2024 and W.P.No.419 of 2025, brought to the notice of this Court that for the very same relief, already the petitioner in W.P.No.36827 of 2025 filed a suit in O.S.No.566 of 2024 on the file of the Additional District Munsif Court, Coimbatore for injunction, in which, I.A.No.2 of 2024 was filed seeking interim injunction, which was rejected. 5. In view of the above facts and circumstances, this Court permits the petitioners who are the defendants in the said suit, to agitate their grievances and approach the Civil Court and the petitioners are at liberty to approach the Civil Court in the said pending suit. Further, the petitioner-Selvaraj has also filed an application in OA.No.8 of 2022 before the Court below, which is pending and hence, this Court grants liberty to the petitioners herein to canvass all the points before the civil Court in the said suit and also in the said O.A.No.8 of 2022. 6. A direction is also issued to the Joint Commissioner of the H.R. & C.E. Department, Coimbatore, to appoint a Fit Person and Archakar for conducting the daily poojas and to look after the administration of the above said Temple, in response to which, the learned Additional Government Pleader submitted that immediately, the Fit Person will be appointed and the Archakas Page No. 6 / 8 https://www.mhc.tn.gov.in/judis W.P.Nos.36827 of 2025, 39740 of 2024 and 419 of 2025will also be appointed, if not appointed till now. However, the persons who are arrayed as accused in the criminal case, may not be given the post of Archaka or Fit Person in the Temple.7. This Court, without expressing any opinion on the merits of the matter, issues a direction also to the petitioners to canvass all their points before the Civil Court where the said suit is pending and also before the Joint Commissioner of H.R.& C.E. Department, Coimbatore, where the said O.A. is pending for disposal. 8. With the above observations and directions, these Writ Petitions are disposed of. There shall be no order as to costs.
