The present appellant was the writ petitioner, who applied for getting admission into UG Medical Course at Union Territory of Puducherry under the Puducherry quota.2. The fourth respondent viz., Centralised Admission Committee (In short 'CENTAC') has completed the admission and they also issued initially provisional selection list and subsequently the final selection list. Before release of the final list, the ranking of Scheduled Caste candidates was released, where, the __________Page 2 of 8https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis W.A No. 3055 of 2025petitioner's name was found at Sl.No.74. Despite that, he could not reach the zone of consideration under the Scheduled Caste category under the Puducherry quota and therefore, he was not selected in the final list. Questioning the same, the said writ petition was filed.3. The learned Writ Court, after having considered the writ petition, dismissed the same mainly on the ground that some of the selectees, whose serial numbers even though shown, have not been made as a party to the writ petition and therefore the selection list cannot be questioned. Therefore, on that ground the learned Writ Court dismissed the writ petition through the impugned order.4. Assailing the same, Mr.P.R.Thiruneelakandan learned counsel for the appellant would contend that, insofar as the issuance of community certificate for Scheduled Caste community people in the state of Puducherry is concerned, the procedure adopted by the authorities is unlawful or against the orders already been passed by the Court, the reason being that, according to the learned counsel, if Scheduled Caste community certificate is sought for, it shall be meant only for those who are residing permanently at Puducherry. He submits that in the present case, one of the parents especially the father belongs to other State and even does not belong Scheduled Caste community and only the mother belongs to __________Page 3 of 8https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis W.A No. 3055 of 2025Puducherry, based on which community certificate has been given to various people, and at least 14 such people who have been selected now for admission into UG Medical Course for the current academic year had been selected under the Scheduled Caste (SC) quota after securing community certificate for SC community only under the category of either father or mother does not belong to Scheduled Caste or either father or mother does not belong to Puducherry.5. If such kind of Scheduled Caste community certificates are given, based on which if the status of Scheduled Caste is claimed by those candidates, their candidature ought to have been rejected by the fourth respondent. Nevertheless, they have been included in the list based on their merit, because of which the candidates like the petitioner, though belongs to Puducherry State and are entitled to get the benefit of Scheduled Caste community certificate are denied such benefit. That was the grievance mainly expressed by the appellant before the writ Court, however the same was not considered and the writ petition was rejected through the impugned order.6. Learned counsel for the appellant also made an attempt to rely upon some judgments saying that, insofar as the grant of community certificate especially Scheduled Caste certificate is concerned, that kind of certificate can be __________Page 4 of 8https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis W.A No. 3055 of 2025given only for the said community ie., both father and mother of the certificate seeker must be from the State (here it is the Union Territory of Puducherry) and suppose if one of the parent belongs to other State and that too another community, the certificate seeker is not entitled. Therefore, if such certificate is given that cannot be taken into account for recognizing the status of such a candidate, he contended.7. We have considered the submissions made by the learned counsel for the appellant and we have also gone through the order impugned as well as the connected document filed before this Court.8. In the order impugned, not only the reason that those selected candidates have not been included as party respondents in the writ petition for which the writ petition was dismissed, the further reason that was stated is that insofar as the community certificate given to those selected candidates are concerned, it seems to have been given only by the competent authority and therefore competency has not been questioned, even the very community certificate has never been questioned in any proceedings. When that being so, since it is settled law that once a community certificate is issued by the competent authority unless it is cancelled, modified or rescinded, the status conferred on the candidate or the __________Page 5 of 8https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis W.A No. 3055 of 2025person for whom such a community certificate is given may be recognized for all purposes, including admission in educational institutions as well as employment opportunities. Those candidates who received such a community certificate since have claimed such status, which has been considered by the fourth respondent for selection and admission into first year MBBS course at the Puducherry State under the SC quota, that kind of procedure adopted by the fourth respondent cannot be found fault with. 9. Therefore, apart from the reasons that have been assigned by the learned Judge in dismissing the writ petition, we have also made added reasons as discussed above, for which also the writ petition ought to have been dismissed. Hence, we do not have any hesitation to hold that the order impugned passed by the writ Court is entitled to be sustained. Accordingly, the order is sustained, as a result of which, the writ appeal fails and the same is dismissed. No costs. Consequently, connected miscellaneous petition is closed.(R.S.K.,J.)
