Mr.D.Ravichander, learned Special Government Pleader takes notice on behalf of the respondents 1 to 8 & 13. By consent of both the parties, this writ petition has been taken up for final disposal at the stage of admission itself.3. Learned counsel for the petitioner would submit that the petitioner has purchased a vacant property to an extent of 1200 sq.ft., in S.No.1196/2E with patta No.814 situated at Plot No.82, Jayam Nagar. Thereafter, the petitioner has applied for mutation of patta and the said application was rejected stating that “notification under process of land acquisition” and the aforesaid land comes under the “Depressed Class Land”. When the petitioner seeks compensation for the aforesaid land, it was informed that the land comes under “Depressed Class”, hence, the petitioner is not entitled for any compensation. Under these circumstances, the impugned order dated 25.04.2025 was passed, seeking certain details from the RDO/third respondent. Pursuant to the impugned order, the petitioner sent a representation dated 22.08.2025, seeking for compensation for the aforesaid land. However, till date no order was passed. Challenging the order dated 25.04.2025, the petitioner has come forward with the present writ petition.5/10 https://www.mhc.tn.gov.in/judis W.P.No.37739 of 20254. After taking instruction, learned Special Government Pleader appearing for the respondents 1 to 8 & 13 submitted that the respondents are in the initial stage of acquisition and now only, they called for certain information from the RDO/third respondent. Hence, he submitted that appropriate orders would be passed.5. Heard the learned counsel on either side and perused the materials available on record.6. I find force in the submission of the learned Special Government Pleader appearing for the respondents 1 to 8 & 13. Since the acquisition proceeding is in initial stage, the respondents are not in a position to fix the compensation. Once they received a reply from the RDO/third respondent, a decision will be taken with regard to the acquisition of land and subsequently, fixation of compensation will come into picture and the same will be paid to the persons, who are all in the possession of the land. Such being the case, filing this writ petition at this stage is pre-mature. In the event if they proceed with acquisition of 6/10 https://www.mhc.tn.gov.in/judis W.P.No.37739 of 2025land, certainly the petitioner is entitled for compensation. It is also made clear that after the fixation of compensation, if there is any failure on the part of the respondents in paying the compensation, the petitioner is at liberty to approach the competent authority to agitate their rights, in the manner known to law. Accordingly, this writ petition stands dismissed. No costs.
