Judgment
Suo Motu TR.No.16692 of 2025IN THE HIGH COURT OF JUDICATURE AT MADRASDATED: 14.10.2025CORAM:THE HONOURABLE MR. JUSTICE D.BHARATHA CHAKRAVARTHYSuo Motu TR.No.16692 of 2025(S.T.C.No.561 of 2023 of District Munsif cum Judicial Magistrate Court, Vedaranyam, Vedaranyam Taluk, Nagapattinam ) For Petitioner : Mr.S.Sugendran Additional Public ProsecutorORDERThis Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.
The case in STC.No.561 of 2023 was taken on the file of the District Munsif cum Judicial Magistrate Court, Vedaranyam, Vedaranyam Taluk, Nagapattinam for the alleged offence under Sections 143 and 341 of IPC. The allegation in this case is that on 01.11.2022, the accused protested against the Government without due permission. The final report was filed on 26.04.2023, and the accused have been facing trial since then. Thus, it can be seen that the allegations concern exercising the democratic right to protest. Given the context and nature of allegations, continuing the trial impinges on the right to a speedy trial of the accused. No useful purpose will be served by continuing the case.
