In respect of the land mentioned in the aforesaid prayer, though it is a patta land belonging to the private respondents or some other persons, there is a Cart Track, in tamil “epytpay; ghij”. The same has been used by local people to go to their respective lands for agricultural activities. Therefore, in order to remove the said encroachment, the present writ petition has been filed. 3. Heard Mr.D.Murugan, learned counsel for the petitioner, Mr.R.P.Murugan Raja, learned Government Advocate for respondents 1 to 3 and Mr.M.Muthusamy, learned Government Advocate for respondent 4. In view of the order that is going to be passed in this writ petition, notice to respondents 5 to 7 is hereby dispensed with. 4. The learned Government Advocate appearing for respondent 4/Block Development Officer would submit that, attempts to remove such encroachments though had been taken in the month of June, 2025, those attempts were thwarted by raising stiff opposition by the private respondents, therefore, it could not be materialized at that time, as they say that such method for removal of encroachment could be taken by the Revenue Authorities, therefore, with the help of such Revenue Authorities, removal of the said encroachments would be undertaken, he contended. 6. In view of the said stand taken by the learned counsel appearing for the Official respondents, this Court is inclined to dispose of this writ petition with the following orders:-(i) That there shall be a direction to respondents 3 and 4 to jointly undertake the removal of encroachment, provided, of course, after giving Page 5 of 8 https://www.mhc.tn.gov.in/judis W.P.No.37312 of 2025proper notice to the private respondents and after finding out the exact extent of Cart Track, that is “epytpay; ghij”, running through the patta land and only to that extent, if any encroachment is made by the private respondents, that could be removed. (ii) Insofar as the remaining patta land belonging to the private respondents or any third parties is concerned, no hindrance be made by the Official respondent. (iii) The needful as indicated above shall be undertaken by respondents 3 and 4 within a period of two months from the date of receipt of a copy of this order.7. To that effect, the directions since are given, this writ petition is accordingly disposed of. However, there shall be no order as to costs. (R.S.K., J.)
