In C.M.P.No.22928 of 2018, while granting an order of interim stay, this Court directed the petitioner/defendant to deposit a sum of Rs.5,00,000/- to the credit of O.S.No.378 of 2013 on the file of the I Additional District Court, Coimbatore.

The learned counsel for the petitioner submitted that in compliance with the said direction, the petitioner/defendant depostied the aforesaid sum before the trial Court on 15.02.2019. A copy of the challan evidencing such deposit has been produced.

The learned counsel for the petitioner further submitted that, during the execution proceedings, the petitioner/defendant settled the entire decretal amount. Therefore, he seeks permission of this Court to withdraw the sum of Rs.5,00,000/- deposited before the trial Court.

In view of the above submissions and as the entire decretal amount has been satisfied, the petitioner is permitted to withdraw the sum of Rs.5,00,000/- deposited to the credit of O.S.No.378 of 2013, along with accrued interest, if any, by filing an appropriate application before the trial Court. https://www.mhc.tn.gov.in/judis __________Page3 of 47.
