Operative part

4.

Though the petitioner claims that he is the son and clause 1 legal heir of the deceased Anjala Mary @ Anjel Mary, no piece of paper is produced by the petitioner showing that he is the legal heir of the deceased. He has not even enclosed the legal heirship certificate issued by the revenue authorities. Upon the demise of a parent, a legal heirship certificate is the only document, which would prove the relationship between the parties and also the legal right. In the absence of the same, the petitioner cannot expect the authorities to act upon his representation and release the huge funds maintained by his mother. Hence, the prayer sought for by the petitioner cannot be granted and this writ petition is liable to be dismissed. Page No.3 of 6 https://www.mhc.tn.gov.in/judis W.P.No.36119 of 20255. Accordingly, this Writ Petition is dismissed. However, the petitioner is at liberty to approach the appropriate authority for obtaining the legal heir certificate and thereafter, he can approach the respondents for disposing his representation.
