It is conducting D.Pharm and B.Pharm courses. The second respondent is the authority occupying the field of pharmacy under the Pharmacy Act which has been reiterated by the latest decision of the Hon'ble Supreme Court. The petitioner applied to the Government of Tamilnadu for grant of permission to start 4 years B.Pharm degree course from the academic year 2020-2021. The Government of Tamilnadu, by order in GO.Ms.No.380 dated 26.08.2019, granted permission to start 4 years B.Pharm degree course with an annual intake of 60 students. From the academic year 2023-24, the petitioner college has been conducting B.Pharm degree course with an intake of 100 seats. The petitioner is conducting B.Pharm degree course with appropriate approvals and affiliation from the second respondent and the first respondent respectively. The petitioner has applied to the second 3/8 https://www.mhc.tn.gov.in/judis W.P.No.34468 of 2025respondent for grant of approval for the academic year 2025-26 with additional course i.e. D.Pharm. 3.In the meanwhile, the second respondent filed an application before the Hon’ble Surpeme Court of India in MA.No.711 of 2025 in CA.No.9048 of 2012 seeking extension of time. The Hon’ble Supreme Court of India, by an order 09.05.2025, allowed the application and extended time for completion of approval process of the institutions up to 31.08.2025 and appeals / compliance process till 30.09.2025 to the applicant / the second respondent herein for the academic year 2025-26 and further extended completion of counselling till 30.10.2025. Based on the order passed by the Hon’ble Supreme Court of India, the second respondent also by its communication dated 11.07.2025, communicated to all the State Governments, examining authorities and admission making authorities the extension of time for completion of approval process 2025-26 for pharmacy institutions requesting them to align with the timeline fixed by the Hon’ble Supreme Court of India. Insofar as the petitioner college is concerned, the second respondent conducted inspection on 12th and 13th of August 2025. After receipt of the said letter, the petitioner has already uploaded all the requirements as required by the second respondent. The first round of counselling was already over in respect of Government seats in Government colleges for 2025-2026. As per the notification, the fourth respondent has extended the date of registration from 06.09.2025 to 09.09.2025 and for choice filling from 07.09.2025 to 10.09.2025, results from 11.09.2025 to 13.09.2025. It is contrary to the direction issued by the Hon'ble Supreme Court of India. 6.In view of the above, the fourth respondent is hereby directed to conduct counselling for B.Pharm degree course (4 years) alone for Government quota seats in self-financing colleges for the academic year 2025-2026 from 01.10.2025 as per the direction issued by the Hon'ble Supreme Court of India in MA.No.711 of 2025 in CA.No.9048 of 2012 dated 09.05.2025. It is made clear that the fourth respondent can conduct counselling for B.Pharm degree course (4 years) 6/8 https://www.mhc.tn.gov.in/judis W.P.No.34468 of 2025for Government quota seats in self-financing colleges for the academic year 2025-2026 from 01.10.2025 irrespective of approval of the petitioner college.7.With the above directions, this writ petition stands disposed of. Consequently, connected miscellaneous petitions are closed.
