Heard the learned counsel appearing on either side and perused the materials available on record.3. The petitioner Institution is a recognized self-financing college in the field of teacher education, conducting the Diploma in Elementary Education (D.EI.Ed) course with an intake capacity of 50 students. The recognition was originally granted on 11.01.2008 under Section 14 of the National Council of Teacher Education Act, 1993. Subsequently, the same was renewed from time to time and the petitioner Institution has been continuously in compliance with the regulations and statutory norms framed by the National Council of Teacher Education.4. While being so, on 27.06.2025, the second respondent passed a resolution withdrawing the recognition of the petitioner Institution, along with several other colleges, on the ground that the petitioner failed to submit Performance Appraisal Reports for the Academic Years 2021-2022 and 2022-2023. Aggrieved by the said withdrawal of recognition, the petitioner filed a writ petition before this Court in W.P.No.21575 of 2025. This Court, by an order dated 18.06.2025, directed the petitioner to approach the Appellate Authority by way of an appeal, as contemplated under Section 18 of the 6/10 https://www.mhc.tn.gov.in/judis WP.No.34347 of 2025National Council of Teacher Education Act, 1993. Till then, the order of withdrawal of recognition was stayed by this Court. Accordingly, the petitioner also filed an appeal on 23.08.2025 before the Appellate Authority, which is presently pending disposal.5. Pending appeal, the respondents published a Public Notice dated 08.08.2025, wherein the petitioner Institution was included in the approved list of eligible colleges for admission for the Academic Year 2025-2026. However, the petitioner was denied permission to participate in the counselling conducted by the SCERT. A similar issue was dealt with by the Hon'ble High Court of Delhi, which, while staying the withdrawal of recognition, directed the National Council of Teacher Education to permit institutions, whose recognition had been withdrawn but was under challenge and stayed, to participate in counselling and admissions during the pendency of their appeals. In the present case also the withdrawal of recognition of the institution has been stayed by this Court till the disposal of the Appellate Authority as contemplated under Section 18 of the National Council of Teacher Education Act, 1993.6. In view of the above facts and circumstances of the cse, the respondents are directed to include the petitioner Institution petitioner Institution in the counselling process for admissions to the Diploma in Elementary Education (D.EI.Ed) course for the Academic Year 2025-2026 and permit the petitioner Institution to admit students. It is made clear that the admissions of the students to the petitioner Institution shall be subject to the result of the appeal pending before the Appellate Authority.8.
