Heard the learned counsel appearing on either side and perused the materials available on record.3. The Petitioner institution is a recognized self-financing college in the field of Teacher Education, established in the year 2006, duly recognised by the Respondent No.2, i.e., South Regional Committee (SRC) of the National Council for Teacher Education (NCTE), to conduct the B.Ed. Degree Courses. The Petitioner institution operates under a properly registered Educational Trust and the Petitioner been conducting B.Ed. courses with valid recognition from the Respondents since 2006 as stated supra. On 11.08.2017, this recognition was duly renewed under the 2017 Regulations framework and the institution has been continuously functioning in compliance with statutory norms. 6/10 https://www.mhc.tn.gov.in/judis WP.No.35199 of 20254. While being so, the second respondent passed a resolution withdrawing the recognition of the petitioner Institution, along with several other colleges, on the ground that the petitioner failed to submit Performance Appraisal Reports for the Academic Years 2021-2022 and 2022-2023. Aggrieved by the said withdrawal of recognition, the petitioner filed a writ petition before this Court in W.P.No.26857 of 2025. This Court, by an order dated 24.07.2025, directed the petitioner to approach the Appellate Authority by way of an appeal, as contemplated under Section 18 of the National Council of Teacher Education Act, 1993. Till then, the order of withdrawal of recognition was stayed by this Court. Accordingly, the petitioner also filed an appeal before the Appellate Authority, which is presently pending disposal.5. Pending appeal, the petitioner was denied permission to participate in the counselling conducted by the SCERT. A similar issue was dealt with by the Hon'ble High Court of Delhi, which, while staying the withdrawal of recognition, directed the National Council of Teacher Education 7/10 https://www.mhc.tn.gov.in/judis WP.No.35199 of 2025to permit institutions, whose recognition had been withdrawn but was under challenge and stayed, to participate in counselling and admissions during the pendency of their appeals. In the present case also the withdrawal of recognition of the institution has been stayed by this Court till the disposal of the Appellate Authority as contemplated under Section 18 of the National Council of Teacher Education Act, 1993.6. In view of the above facts and circumstances of the case, the respondents are directed to include the petitioner Institution in the counselling process for the Academic Year 2025-2026 and permit the petitioner Institution to admit students. It is made clear that the admissions of the students to the petitioner Institution shall be subject to the result of the appeal pending before the Appellate Authority.7. With the above direction, this Writ Petition stands disposed of.
