Thiru Varadhapillai namely Mrs. Sangodhi, Mr. Pachayappan, Mrs. Kamatchi and Rameshkumar as per the Legal Heirship certificate issued by the third respondent dated 06.03.2018.2.Mr.D.Ravichander, learned Special Government Pleader, takes notice on behalf of the respondents. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.3.Learned counsel for the petitioner would submit that the petitioner father Late Thiru Varadhapillai owned the lands in S. No 16/7, (16 Ares), 16/8 (42.5 Ares), 16/11 (6 Ares) and 16/12 (8.5 Ares) in the Marur Village. The said lands are all used as Agricultural lands and we are carrying on cultivation with the rainfed lands. During the year 1998, the respondents 2 and 3 resorted to acquisition proceedings for a part of the above lands except for a small part of S. No 16/8, for the purpose of giving house sites to Adi-Dravidas of the said area. The petitioner's father challenged the same in W.P. No 6822 of 1998. After the said judgement was issued, the petitioner's father made a representation to the third respondent / Tahsildar on 02-09-2011 for issuance of the patta for his entire extent of the lands after quashing of the acquisition proceedings. But the entries in the Revenue records that were made at the time of the earlier acquisition proceedings have not been deleted and the same ought to have been automatically deleted on the quashing of the acquisition proceedings.4.He would further submit that the petitioner's father Thiru Varadhappillai passed away on 27-11-2012 and his request dated 02-09-2011 was not complied with by the 3rd respondent. The entries in the revenue records still remain in the name of the Adi-Dravidar welfare department. Though the petitioner has given an application for issuance of patta on 07-06-2019 and also representations dated 23-06-2020, 08-07-2020 and have been following up with regular visits to the office of the respondents, the petitioner has been driven from one office to the other on various excuses. Though letters dated 13-07-2020 and 22-07-2022 https://www.mhc.tn.gov.in/judis WP No. 35465 of 2025from one respondent to the other is issued with copies marked to the petitioner, no action has been taken till date to issue the patta for the lands vested with the petitioner's family in our favour and till date the respondents have not carried out the deletion of the entries in respect of the petitioner's lands in the revenue records. Hence, the present writ petition.5.Learned Special Government Pleader appearing for the respondents would submit that in the present case enquiry has been conducted based on the representation of the petitioner dated 23-06-2020, 08-07-2020 and the respondents are in the process of updating the records and he seeks 15 days time to complete the same.6.Heard the learned counsel for the petitioner as well as the learned Special Government Pleader appearing for the respondents. https://www.mhc.tn.gov.in/judis WP No. 35465 of 20257.Considering the submissions made by either parties, this Court is of the view that since the original acquisition proceedings have been quashed by this Court in W.P.No.6822 of 1998, as rightly contended by the learned counsel for the petitioner the entries in the revenue records of the subject land pertaining to the acquisition proceedings has to be removed and the petitioner's name in the capacity of the legal heirs of the original land owner has to be incorporated. Though the petitioner made a representations in this regard on 23-06-2020, 08-07-2020, till date the respondents have not acted upon. Its surprising why the respondents failed to mutate the records and kept the representations pending for the period of five years, even then the enquiry has also been conducted in the present case. Since the leaned Special Government Pleader assured that the entire process will be completed within 15 days, this Court taking note of said submission, directs the respondents to mutate the revenue records in the name of the legal heirs of the petitioner's father as requested by the petitioner through his representations dated 23-06-2020, 08-07-2020 within a period of 15 working days from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis WP No. 35465 of 20258.With the above directions, this writ petition is disposed of.
