Srinivasan,Special Public ProsecutorORDERThis petition has been filed to enlarge the petitioner on bail pending in Crime.No.RC032 2025A0017 of 2025 for the alleged offences u/s. 61(2) of BNS 2023 and Section 7, and 12 of Prevention of Corruption Act, 1988 on the file of the respondent.2. The case of prosecution is that from the source of information received by the CBI, ACB Chennai regarding the habit of receiving bribe by the petitioner/accused A1 Rameshkumar who was working as Assistant Labour Commissioner (Central), Ministry of Labour and Employment, Government of India, Puducherry. In order to issue/renewal of labour license the petitioner used to demand and accept money from the private entities. On such source of information which revealed that M/s. KMC Associates, Theni engaged in https://www.mhc.tn.gov.in/judis CRL OP No. 24442 of 2025construction and maintenance of motor ways, streets, roads, other vehicular and pedestrian ways, high ways, bridges, tunnels and subways, had undertaken NHAI road contract in Trichy and applied for two labour license at the office of the Assistant Labour Commissioner, Puducherry. The company did not have labour license their payment is pending with NHAI. A4 Saravanakumar who is the manager of KMC Associates was pursuing labour license from the petitioner/A1. The petitioner/A1 asked the accused A4 to come and meet him personally on 14.08.2025. On such meeting the petitioner/A1 demanded a sum of Rs. 75,000/- each to grant two labour license. After negotiation the petitioner/A1 agreed to receive a sum of Rs. 1,00,000/- in total for the two labour license and he wanted the said amount in cash. On 21.08.2025, the accused/A3 Shyam Director of the Company informed A2 Arunkumar that Ilango petitioner/accused/A5 was waiting outside with the money. This was informed to the petitioner/accused/A1. The petitioner/A5 went inside the office of the Assistant Labour Commissioner and handed over the cash of Rs. 1,00,000/- which was kept on the table in the chamber of the petitioner/A1. The CBI police arrested the petitioners A1 and A5 and also recovered the cash of Rs. https://www.mhc.tn.gov.in/judis CRL OP No. 24442 of 20251,00,000/- from the petitioner/A1. A case was registered in the above said number and the petitioners/A1 and A5 are in judicial custody. 3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this as if he was conspired with other accused. Further, he submits that based on instruction of the A2 to A4, who are friends of the petitioner, he handed over the money to A1. He was not aware of the demand nor acceptance of illegal gratification money by other accused persons. Hence, he prays to allow this petition.4.The learned counsel for the respondent submits that for issue of two labour license first accused demanded bribe. Upon instruction of other accused, the petitioner went into the chamber of the A1 and handed over the cash of Rs. 1,00,000/-. The petitioner was asked to hand over the money to the A1 upon instruction of the other accused the money was send to petitioner through electronic mode and it was encashed by the petitioner and handed over the same to the A1. Based on the credible information, said process was followed and intercepted by the respondent and petitioner caught red handed. https://www.mhc.tn.gov.in/judis CRL OP No. 24442 of 2025Further, two accused are still absconding. Hence, he prays to dismiss this petition.5. On the other side, the learned counsel for the petitioner submits that one of the accused was present at the time of the alleged arrest but he was not secured by the respondent. 6. Considering the facts and circumstances of the case and also the fact that the allegation against the petitioner is that he had handed over the money to the first accused at that time he was arrested and also the said amount was recovered by the respondent police. Further, the investigation is almost completed. Hence, this Court is inclined to grant bail to the petitioner with certain conditions. 7. Accordingly, the petitioner is ordered to be released on bail on executing separate bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, in which one surety must be a blood surety for a like sum to the satisfaction of the District Sessions Judge and Special Judge for PC Act cases, Puducherry, and on further conditions that: https://www.mhc.tn.gov.in/judis CRL OP No. 24442 of 2025(a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;(b) the petitioner shall report before the respondent police on daily at 10.30 a.m. Until further orders.(c) the petitioner shall not tamper with evidence or witness either during investigation or trial;(d) the petitioner shall not abscond either during investigation or trial;(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs.
