For Petitioner: Mr.R.Shanmugasundaram, Senior Counsel for M/s.A.G.ShakeenaFor Respondents For R2 & 4 : Mr.S.Arumugam, Government AdvocateFor R1 & 3: Mr.U.Baranidharan, Standing CounselO R D E RThis writ petition has been filed challenging the order passed by the first respondent dated 31.07.2025 thereby suspending the 2/10 https://www.mhc.tn.gov.in/judis W.P.No.33710 of 2025affiliation for the academic year 2025-26 and the consequent order dated 28.08.2025, thereby rejecting the request made by the petitioner for revocation of suspension order on affiliation.2.The petitioner was granted approval from All India Council for Technical Education (hereinafter called as “AICTE”) during the academic year 2002-03. Thereafter, the first respondent had granted affiliation to the petitioner college during the academic year 2002-03. While being so, on 20.03.2025, AICTE had granted approval to the petitioner college for the academic year 2025-26. In pursuant to the recognition, the petitioner had applied for extension of affiliation before the third respondent and paid necessary fees. Thereafter, the third respondent inspected the petitioner college and was satisfied with all the infrastructural and instructional facilities. After verification of the staff and infrastructural facilities, the inspection committee had uploaded a report and on the report, notice was sent to the petitioner on 25.06.2025 noting certain staff deficiency in the Science, Humanities and General Engineering and certain deficiencies in the lab equipments. Once again, the petitioner cleared the deficiency and uploaded the details of the staff 3/10 https://www.mhc.tn.gov.in/judis W.P.No.33710 of 2025as well as the lab equipments in the portal of the first respondent on 27.06.2025. Even then, without being satisfied with the same, the first respondent issued show cause notice on 09.07.2025 and after receipt of the same, on 12.07.2025 once again the petitioner uploaded the details of the staff as well as the lab equipments. Once again, deficiency report was served on the petitioner on 15.07.2025. Once again, the petitioner submitted compliance report and after receipt of the same, continued deficiency report was served on 17.07.2025. While being so, in the Engineering Admission Counselling for the year 2025-26, 9 students have been allotted to the petitioner college for the first year B.E. Course on 31.07.2025 and 51 students for lateral entries have been allotted. The petitioner also admitted 42 students under lateral entries and 56 students in the first year B.E. Course through consortium and 85 students have been admitted in M.B.A.course. During the admission counselling process, the first respondent by an order dated 31.07.2025, communicated to the petitioner on 03.08.2025, thereby suspending the programme of the petitioner college for the academic year 2025-26 pointing the staff deficiencies in the Science and Humanities Faculties and the Principal of the college. Therefore, the petitioner was constrained to approach this 4/10 https://www.mhc.tn.gov.in/judis W.P.No.33710 of 2025Court in WP.No.31428 of 2025 and this Court passed an order dated 19.08.2025 directing the respondents to consider the petitioner's documents and pass orders on merits and in accordance with law. After enquiry, by an order dated 28.08.2025, the first respondent stated that the petitioner college has fullfilled the minimum criteria for 7 UG programmes and MBA programmes and the minimum criteria was not satisfied for post graduation in ME courses. Even according to the respondents, the petitioner paid fees on 28.11.2024 itself for seeking extension of affiliation with the first respondent. However, the first respondent issued deficiency notice only on 17.06.2025. Now, though the petitioner has satisfied minimum criteria for 7 UG programmes and 1 MBA programme, as per the deadline fixed by the Hon'ble Supreme Court of India, the last date for grant of affiliation was 14.08.2025. Therefore, the request made by the petitioner was not considered and the order of suspension of affiliation was confirmed. 3.The first respondent filed counter and on instruction, the learned Standing Counsel appearing for respondents 1 & 3 submitted that now the seats which were already allotted in favour of the petitioner college has been re-allotted to some other college. Further as per the 5/10 https://www.mhc.tn.gov.in/judis W.P.No.33710 of 2025order passed by the Hon'ble Supreme Court of India, the affiliation cannot be renewed or granted after 14.08.2025. 4.Heard, the learned counsel appearing on either side and perused all the materials placed before this Court.5.Admittedly, the petitioner submitted application for extension of affiliation on 28.11.2024. However, the petitioner was noticed about the deficiency only on 17.06.2025. Though the petitioner submitted several documents complying with the deficiencies noted by respondents 1 to 3, the request made by the petitioner was kept pending beyond the date of 14.08.2025. In fact, this Court passed order dated 21.08.2025 in WP.No.31428 of 2025 directing respondents 1 to 3 to consider the documents which were filed by the petitioner and, after giving opportunity of personal hearing, to dispose of the application for renewal of affiliation. If at all the last date for affiliation is 14..08.2025, the respondents would have brought to knowledge of this Court that after 14.08.2025, the affiliation of the petitioner cannot be considered. Even according to respondents 1 to 3, now the petitioner has fulfilled minimum 6/10 https://www.mhc.tn.gov.in/judis W.P.No.33710 of 2025criteria and the first respondent is also satisfied with the same in respect of 7 Bachelor of Engineering Degree courses and 1 Master of Business Administration degree course. 6.In view of the above, the order impugned cannot be sustained insofar as the aforementioned courses. As such, the impugned orders are quashed insofar as 7 under-graduation courses and 1 Master of Business Administration course referred in serial No.1 to 7 & 8 of the impugned order dated 28.08.2025 and the petitioner is granted extension of affiliation for the academic year 2025-26 for the said UG and MBA courses alone. However, insofar as the other post graduation degree courses, the petitioner ought to have submitted compliance report before respondents 1 to 3 for grant of affiliation. 7.In the result, this writ petition stands partly allowed. Consequently, connected miscellaneous petitions are closed.
