The Contempt Petition has been filed to punish the Teachers Recruitment Board for non compliance of the order dated 09.01.2024, passed by this Court in W.P.No.330 of 2024.2. Therefore, the issue involved in both the petitions are one and the same and therefore, this Court is inclined to pass common order in both the petitions. The parties are referred to as per their ranking in the contempt petition. 3. The writ petition was filed for direction directing the respondent to permit the petitioner to participate in the selection by direct recruitment to the post of Graduate Teacher/B.T. Assistant (Science) as per notification No.03/2023 dated 25.10.2023 and the Addendum Notification No.03A/2023 dated 15.11.2023 issued by the respondent by considering B.Sc., (Bio-Chemistry) degree obtained by the petitioner to the post of B.T. Assistant (Science) based on the merit in selection. This Court by an order dated 09.01.2024, disposed the writ petition with a direction to the respondent to Page 3 of 8 https://www.mhc.tn.gov.in/judis Rev.Appln(W).No.216 of 2025and Cont.P.No.2426 of 2024accept the application submitted by the first respondent and consider the same to the post of B.T. Assistant (Science) on merits and in accordance with law. 4. The petitioner possessed degree in B.Sc., (Bio Chemistry) obtained from Thiruvalluvar University in the year 2007. After completion of Teachers Eligibility Test, she applied for the post of B.T. Assistant (Science) as per the notification issued by the respondent. However, her application was not considered, since the degree of B.Sc., (Bio Chemistry) is not equivalent to B.Sc., (Chemistry). This Court referred the government order in G.O.Ms.No.254, Personnel and Administrative Reforms (R) Department dated 22.10.1998 in which, it was ordered that the B.Sc., (Bio Chemistry) is equivalent to B.Sc., (Chemistry). Further the letter No.38561/M/2008-3 of the year 2010, clarified that the degree in B.Sc., (Bio Chemistry) obtained from all Universities is equivalent to B.Sc., (Chemistry). Further as per the government order in G.O.Ms.No.24 Personnel and Administrative Reforms (M) Department dated 04.02.2011 B.Sc., (Bio Chemistry) is equivalent to B.Sc., (Chemistry) obtained from all State Universities recognized by UGC. Only on the basis of the government order in G.O.(Ms).No.72 Higher Education (K2) Department, dated 30.04.2013 B.Sc. (Bio Chemistry) from any University is not equivalent to B.Sc.,(Chemistry). Further, the petitioner had completed her B.Sc., (Bio Page 4 of 8 https://www.mhc.tn.gov.in/judis Rev.Appln(W).No.216 of 2025and Cont.P.No.2426 of 2024Chemistry) in the year 2007. Therefore, as per the letter No.38561/M/2008-3 and the government order in G.O.Ms.No.254 Personnel and Administrative Reforms (R) Department dated 22.10.1998, this Court concluded that B.Sc., (Bio Chemistry) obtained by the petitioner is equivalent to the B.Sc., (Chemistry) and issued directions. 5. Heard the learned counsel appearing on either side and perused the materials placed before this Court. 6. The learned Additional Advocate General appearing for the respondent produced a copy of the government order in G.O.Ms.No.254 Personnel and Administrative Reforms (R) Department dated 22.10.1998 and it is revealed that those who have obtained B.Sc., (Bio Chemistry) from the Bharathiyar University is equivalent to B.Sc.,(Chemistry). Whereas the petitioner has obtained B.Sc., (Bio Chemistry) degree from Thiruvalluvar University and as such, the said government order is not applicable to the petitioner. Further the letter No.38561/M/2008-3 does not reveal that B.Sc., (Bio Chemistry) degree obtained from the Thiruvalluvar University is equivalent to B.Sc., (Chemistry). At the time of passing order in the Writ Petition, it was not brought to the notice of this Court. Page 5 of 8 https://www.mhc.tn.gov.in/judis Rev.Appln(W).No.216 of 2025and Cont.P.No.2426 of 20247. In view of the above facts and circumstances, the order passed in the writ petition cannot be sustained and is liable to be recalled. Accordingly, the order dated 09.01.2024 passed in W.P.No.330 of 2024 is hereby recalled and the Writ Petition stands dismissed and also the Review Application (W) is allowed. Consequently connected miscellaneous petition is closed. There shall be no order as to cost. 8.
