Mr.R.Bharanidharan, learned Standing counsel takes notice for Respondents 1 and 2 and Mr.K.Surendran, learned Additional Government Pleader takes notice for the 3rd Respondent.3. The case of the petitioner is that he applied for Group IV as well as Group IIA examinations conducted by Tamilnadu Public Service Commission (TNPSC). The notification with regard to Group IV was released on 30.01.2024 and the notification with regard to Group IIA was released on 20.06.2024 and the date of examination for Group IV held on 08.06.2024 and Group IIA Preliminary examination was subsequently held on 14.09.2024 and the main exam was conducted on 08.02.2025. The results of Group IV examination was published on 28.10.2024 and Group IIA examination results were published on 05.05.2025. The petitioner has attended the counselling for Group IV examination on 14.02.2025 and subsequently he has been selected for the post of Junior Revenue Assistant and orders of provisional allotment came to be issued on 15.04.2025 which was received by the petitioner on 21.04.2025. Meanwhile, Group II A results were published on 05.05.2025 wherein the petitioner has secured 25th rank under Ex Service man quota. Since there is a possibility to get selected in Group IIA, he has submitted a representation dated 26.06.2025, stating that in the results which was published for Group IIA, he has secured 25th rank under Ex Service man quota and also informed that he is not willing to join in the post which was allotted under Group IV. The petitioner has also attended the screening 3 of 8 https://www.mhc.tn.gov.in/judis W.P.No.33113 of 2025with regard to Group IIA post on 01.08.2025 and on the same day he has been given provisional allotment by hand for the post of Assistant in Revenue Administration and Disaster Management Department, Chengalpattu. After the completion of screening, the petitioner has been served with impugned communication dated 11.08.2025 vide Memorandum No.931/PSD-A2/2024, informing that though the petitioner has been allotted with the post of Assistant in the Revenue Department in Chengalpattu District, based on the Certificate verification at the time of counselling and on subsequent verification regarding employment status, it is found that the petitioner has already been selected for the post of Junior Revenue Inspector in Thiruvallur District in Group IV service vide notification dated 30.01.2024 and thereby he is not allowed to join the Group IIA post. Challenging the same, the present Writ Petition has been filed.5. The learned counsel for the petitioner would submit that the petitioner stands similar to that of one R.Saravanan and others in W.P.No.11995 and batch of 2024 wherein favourable orders have been passed by this Court on 11.06.2025. He would further submit that the learned Single Judge while considering the case in W.P.(MD) No.11995 4 of 8 https://www.mhc.tn.gov.in/judis W.P.No.33113 of 2025of 2024 batch, held in paragraph No.13 that it is not the case where the Ex-servicemen were already joined in one service that is Group-IV and thereafter, applied to other service called for in Group II(A) services. Neither petitioners have got any selection through promotion from the Department where they have joined. As they had applied to the post called under Group-IIA also, even before they got selected and joined in Group-IV service, directed the respondents therein to consider the claim of the petitioners therein for appointment to the post of Group IIA posts under Ex-servicemen category in pursuant to the notification No 3 of 2022, dated 23.02.2022 on the basis of merit and allow them to participate in further selection process. As against the said order of the learned Single Judge, a Writ Appeal was preferred by TNPSC in W.A.(MD) No.1470 and batch of 2024 and the same was dismissed by the Division Bench of this Court. Thereby the case of the petitioner falls similar to that of Saravanan and others case cited supra.6. Mr.R.Baranidharan, learned Standing Counsel appearing for TNPSC would submit that as against the order passed by the Division bench of this Court, the respondents have preferred Special Leave Petition and the same is pending before the Hon'ble Supreme Court. 5 of 8 https://www.mhc.tn.gov.in/judis W.P.No.33113 of 20257. Taking into consideration the fact that the petitioner is a similarly placed person as that of the case of R.Saravanan and others cited supra, this Court directs the respondents to consider the claim of the petitioner for appointment to the post of Group IIA under Ex-servicemen category in pursuant to the notification No.3 of 2022, dated 23.02.2022 on the basis of merit and allow him to participate in further selection process. However, appointment if any made shall be subject to the outcome of the orders passed by the Hon'ble Supreme Court in the Special Leave Petition.8. With the above observation, this Writ Petition stands disposed of. No costs.
