No.88/2024 and etc. batch.2. The said industrial dispute was raised by the petitioner Management and the major issue that was raised before the Labour Court was regarding maintainability of the industrial dispute. The Labour Court had analysed the said issue of maintainability of industrial dispute as primarily issue raised by the management is a mixed question of fact and law which requires oral and documentary evidence and cane be decided along with the other issues after completion of trial. The labour Court ultimately rejected the prayer of the petitioner to try the issue regarding maintainability of the industrial dispute as primary issue and imposed a cost of Rs.5000/- on each petition observing that that workmen/respondents were struggling to get justice for more than 40 years. The petitioner is principally aggrieved by the award of cost imposed on it in each of the industrial disputes. 4. Without going into the arguments advanced on both sides, considering the fact that the issue between the parties as a chquered history and the respondent/workmen are agitating for the past 40 years, this Court is inclined to dispose of the writ petition with the following directions:1. The cost imposed by the Labour Court in each of the industrial disputes is set aside;2. The parties are directed to canvass all the points before the Labour Court on the merits of the case; and 3. The labour Court is directed to dispose of the industrial dispute as expeditiously as possible and in any case within a period of three months from the date of receipt of a copy of this order. 5. With the above direction, the writ petition is disposed of.
