From the above narration, it is obvious that some transfers were 13/22 https://www.mhc.tn.gov.in/judis W.P No.29498 of 2024 etc., batch caseseffected on the basis of complaints. But according to the petitioners, transfer orders were issued with mala fide intent to victimize the petitioners and as a punishment.4. However, the said contention was stoutly objected by the learned Standing Counsels appearing on behalf of the respondents, and would contend that the petitioners are liable for transfer in accordance with their appointment conditions and that, all the transfer orders are administrative in nature, and there is no mala fide or bias against these petitioners. Though in some cases, the petitioners were transferred on the basis of the complaint of the passengers that cannot be faulted as it is administratively required to keep up the concerned person away for certain period as the same would ease the tense situation. Hence, the learned counsel would contend that those transfer orders could not be interfered with under Article 226 of the Constitution of India.5. I have given my anxious consideration to either side submissions and also perused the materials available on record.6. Before delve into the individual rights, this Court would like to refer 14/22 https://www.mhc.tn.gov.in/judis W.P No.29498 of 2024 etc., batch casesthe legal position in respect of the administrative transfer. It is well settled principle of law that the transfer is the incidence of service. Such administrative transfer can be challenged, only if the transfer order has been issued by an incompetent authority, or issued with mala fide intent. In the case on hand, the petitioners challenge the competency of the authority in issuing the transfer order, on the premise that the Standing Order of the respondent Corporation do not give power to the authority to transfer the employee. Let us discuss the defence of competency after considering the defence of mala fide.7. Coming to the mala fide as extracted in the tabular column, in some of the cases, the mala fide had been attributed against the authorities. But admittedly, the concerned authority has not been impleaded in his individual capacity. Therefore, the question of mala fide though pleaded, there is no specific allegation against the individual officials and it is only a vague one.8. It is also relevant to mention that the place or post cannot be chosen by the employee. The employer, who manages the organization is an appropriate person to post the employees as per the requirement to advance the effective administration. It is further well settled principles of law that the 15/22 https://www.mhc.tn.gov.in/judis W.P No.29498 of 2024 etc., batch casesCourt, while administering the power of judicial review should not attempt to micro manage the action of the authorities concerned. The interference in the administrative transfers is beyond the realm of the power of judicial review. But if the petitioners have got any grievance, against the transfer, it is for them to give a representation to the concerned authorities and the concerned authorities are the best person to take a call on their individual grievance and requirements.9. Coming back to the defence of incomptency of the authority to issue transfer order, it is the primordial contention of the learned counsel for the petitioners, that the Standing Orders of the respondent Corporation does not contain any clause for transfer. In this regard, the learned counsel relied upon the Judgment of the Hon'ble Supreme Court in The U.P. State Electricity Board and Another. vs. Hari Shankar Jain and Others reported in (1978) 4 SCC 16. Through which, the learned counsel would submit that the Standing Orders is an essential document to define the terms of the employment of workmen in industrial establishment. When such a document does not give authority to transfer, the impugned transfer order becomes ipso facto void.16/22 https://www.mhc.tn.gov.in/judis W.P No.29498 of 2024 etc., batch cases10. In order to assess the above issue, it requires to go in to definition of “Standing Orders” as defined under the The Industrial Employment (Standing Orders) Act, 1946. As per the above Act, “Standing Orders” mean rules relating to matters set out in the schedule. By referring to the above provisions, the Hon'ble Supreme Court in Rohtak Hissar District Electricity Supply Co. Ltd., vs. State of Uttar Pradesh and Others reported in AIR 1966 SC 1471 has held that when the schedule does not contain any clause for transfer, it is not advisable, to include transfer in the standing order. It is in this back ground, in the Standing Order Appeal 4/1995, (where the respondent's standing order was approved with some modification) the Principal Labour Court, Chennai has deleted the clause “transfer”. It is relevant to refer that, the mere non-inclusion of transfer clause in the Standing Order does not mean that the authorities have no power to transfer the employee.11. As a matter of fact, the Standing Order does not prohibit the transfer of workmen from one establishment to another establishment of the Corporation. This Court is of the view that, the respondents are competent to transfer the employees as per the appointment conditions. In this regard, it is useful to refer the Judgment of the Hon'ble Supreme Court in the case of Divgi Metal Wares Ltd., vs. Divgi Metal Wares Employees Association and 17/22 https://www.mhc.tn.gov.in/judis W.P No.29498 of 2024 etc., batch casesAnother reported in 2024 SCC Online SC 366. Therefore, this Court does not find any merit in the objections of “incompetency” raised by the petitioners'.12. Hence, this Court is of the firm view that there are no grounds to interfere with the Transfer Orders, and these writ petitions are liable to be dismissed. However, if the petitioners are having any personal inconvenience or medical ground or any other valid ground, they are at liberty to give a representation to the respondents within a period of two (2) weeks from the date of receipt of a copy of this order. If any representations are received, the respondents are directed to consider the same and pass orders according to its own merits and in accordance with law within a period of four (4) weeks, thereafter.13. In the result, these writ petitions are dismissed with above directions. No costs.
