It is the case of the petitioner that he had completed the Draughtsman (Civil) course in the year 2022 after completing his higher secondary school education. On 13.01.2023, the respondent had issued Notification No.2 of 2023, calling for applications for the post of Road Inspector in the Rural Development and Panchayat Raj Department with a National Trade Certificate required for eligibility. The petitioner was an eligible candidate and had therefore made an on-line application for the examination. The petitioner had thereafter forwarded the application along with the necessary documents and the respondent had accepted the petitioner's eligibility for the notified post. They had assigned a registration number to the petitioner.3. The petitioner would submit that the examination was 2/9 https://www.mhc.tn.gov.in/judis W.P.No.30871 of 2025conducted on 07.05.2023 and he had participated in the same. Thereafter, the respondent declared that he had cleared the examination. Since over qualified persons were also permitted to attend the examination, the Madurai Bench of this Court in W.P(Md) No.6962 of 2023 had allowed a writ petition challenging the same on 01.06.2023. 4. The petitioner would further submit that he was under the impression that the respondent would take a longer time to processing the application and he had undertaken a course in Catering and Hotel Management. This course required a compulsory internship of one month and accordingly the petitioner had begun his industrial training at Somerset Hotel, MRC Nagar, Greenways, Chennai. 5. While so, a communication dated 28.07.2025 was sent to the petitioner through an SMS message, asking him to check the 3/9 https://www.mhc.tn.gov.in/judis W.P.No.30871 of 2025website of the respondent. This was followed by an email dated 29.07.2025 stating that the certificate verification for the post of Road Inspector in the Rural Development and Panchayat Raj Department would be conducted on 06.08.2025 and the petitioner was directed to appear in person with the original certificates on 06.08.2025 at 11.30 am.6. It is contention of the petitioner that owing to his eduction, he had failed to notice the message dated 28.07.2025 and the e-mail dated 29.07.2025. On 06.08.2025, he was informed by a friend that the certificate verification had been conducted from 04.08.2025 only then did he come to know that he had been selected for the post of Road Inspector in the Rural Development and Panchayat Raj Department. Immediately, on 07.08.2025, the petitioner gave a representation to the respondent requesting permission to participate in the certificate verification process, despite which, the respondent had not considered the request. Therefore, this Writ Petition has been filed. 4/9 https://www.mhc.tn.gov.in/judis W.P.No.30871 of 20257. Mr.Mr.I.Abrar Md.Abdullah, learned standing counsel on behalf of the respondent on instructions would submit that since the petitioner had not appeared on 06.08.2025, the vacancy against his name was alloted to the next person as per the roster and therefore, as on date no vacancy exists.8. Heard the learned counsels on either side and perused the materials available on record.9. The petitioner, who applied for the post of Road Inspector, was informed through an SMS dated 28.07.2025 and an e-mail dated 28.07.2025 that the certificate verification was to take place on 06.08.2025. The only reason given by the petitioner for not noticing the above messages is that his internship and studies. This Court is surprised with this response. In his affidavit it has been stated in paragraph 8 as follows:-“8. It is submitted that only then the Petitioner 5/9 https://www.mhc.tn.gov.in/judis W.P.No.30871 of 2025came to know that he was selected for the post of Road Inspector in Rural Development and Panchayat Raj Department. After knowing the same the Petitioner immediately approached the Respondent on 07.08.2025 and gave a representation requesting to allow him to participate in the certificate verification process. It is further submitted that the Petitioner had given a mail to the respondent on 06.08.2025 at 10.46PM from his mail id Gokul Raja, [email protected] to the respondent mail ID: sopsdtech2, [email protected]. It is further submitted that the petitioner had given another e-mail to the respondent's other mail IDs on 07.08.2025 at 5.22 AM to the e-mail id of the respondent in [email protected],[email protected],contacttnpsc@gmail. com. The respondent had not given any reply to the request made by the petitioner. The certificate verification process continued and ends on 07.08.2025. The Petitioner's representation was not considered and he 6/9 https://www.mhc.tn.gov.in/judis W.P.No.30871 of 2025was rejected from the certificate verification process orally, stating that the schedule fixed in the call letter is on 06.08.2025 at 11.30 AM. However, in the e-mail addressed by the petitioner on 07.08.2025 at 5.22 am to the respondent, the petitioner has stated as follows:“The counseling for my candidature was scheduled on 06/08/2025. However, I could not attend the same as no physical intimation (postal/Tapal notice) was served to me. The only communication received was through email, which unfortunately came to my notice late in the evening of 06/08/2025, after the counseling session for my batch had concluded.”Therefore, it is clear that the reasons given in the affidavit and the e-mail to the respondent are totally different. The petitioner has not been able to come up with a true statement as to why he had not attended the interview on 06.08.2025. The petitioner has conveniently suppressed the SMS message dated 28.07.2025. That 7/9 https://www.mhc.tn.gov.in/judis W.P.No.30871 of 2025apart, the post has already been filled up and entertaining the petitioner's application at this stage would result in reopening the litigation. Therefore, in the light of the above discussion, I see no reason to grant the mandamus as sought for by the petitioner and accordingly, the writ petition is dismissed. No costs.
