The case of the petitioners is that they are working as Senior Inspector in Vellore District. While so, the 3rd respondent issued orders for 25 temporary promotion for the post of Senior Revenue Inspector from various posts for the year 2022-2023 and subsequently, during May 2022, the 3rd respondent prepared a promotion panel without getting any approval from the 1st respondent and he assessed the estimate vacancy as 30 and the total final promotions given effect to by the 3rd respondent is 33. However, the 1st respondent fixed the estimate vacany for promotion as 13 and subsequently, the 2nd respondent sent a proposal to the 1st respondent for getting approval for 13 estimate vacancy for promotion post, and the 1st respondent granted https://www.mhc.tn.gov.in/judis W.P.No.30395 of 2025approval for 13 estimate vacancy for promotion post for the post of Senior Revenue Inspector. Further, the 1st respondent, vide letter dated 02.07.2025 bearing No.Na.Ka.Pani-4(4)/01-30/344/2024 stated that as per Section 7(1) of the Tamil Nadu Government Employees (Conditions of Service) Act, 2016, the list of approved candidates, so prepared shall be in force for a period of one year only and the same shall lapse at the end of year. However, the 2nd and 3rd respondents have not implemented the said communication of the 1st respondent and till date, the revised seniority list of 13 persons as per the vacancy assessment report for the year 2022-2023 has not been published, despite the representation dated 07.07.2025 sent by the 1st petitioner. Hence, this writ petition.3. Learned counsel for the petitioners submits that in respect of the promotion of the petitioners, the 1st respondent has sent a communication to the 2nd and 3rd respondents, however, no action has been taken on the same and they have not come forward to prepare the seniority list. Hence, the 1st petitioner sent a representation on 07.07.2025 to the 3rd respondent seeking to implement the 1st respondent's communication dated 02.07.2025, which https://www.mhc.tn.gov.in/judis W.P.No.30395 of 2025evoked no response. Hence, the learned counsel for the petitioners submitted that, it would suffice, if this Court issues a direction to the 2nd and 3rd respondents to implement the communication sent by the 1st respondent in his letter Na.Ka.Pani-4(4)/01-30/344/2024, dated 02.07.2025, by considering the 1st petitioner's representation dated 07.07.2025.4. Per contra, the learned Additional Government Pleader appearing on behalf of the respondents submitted that the 2nd respondent, vide communication dated 26.08.2025 bearing No.Na.Ka.A2/3296/2022, addressed to the 1st respondent, has acted upon the communication dated 02.07.2025 of the 1st respondent and thereby, nothing survives for further adjudication, as the matter has become infructuous.5. From the aforesaid submissions and also on perusal of the materials available on record, it is seen that, the 2nd respondent has sent a communication dated 26.08.2025 to the 1st respondent and thereby, communication dated 02.07.2025 of the 1st respondent has been acted upon. https://www.mhc.tn.gov.in/judis W.P.No.30395 of 20256. However, before signing the order dated 09.09.2025, it was found that the communication dated 26.08.2025 of the second respondent did not carry any reference to the communication dated 02.07.2025 of the first respondent and hence, the matter was directed to be listed today under the https://www.mhc.tn.gov.in/judis W.P.No.30395 of 2025caption “for clarification”.4.Today, Mr. V.
