It is further placed before this Court on behalf of the petitioner/claimant and the respondent/Transport Corporation that there is huge due payable by the Transport Corporation to the petitioner, which has resulted in the filing of the present writ petition. It is further submitted by the learned counsel appearing for the petitioner that there is no contract provides for pursuing arbitration and that there is no formal agreement between the petitioner and the respondent to resort to arbitration. However, learned counsel appearing for the respondent Corporation submitted that the claim raised in the present writ petition is a disputed question of fact, which cannot be gone into in a writ petition.4. However, when this Court pointed out that without agitating the issue any further, the best option open for the parties would only be to resolve the dispute amicably, which alone would give a quietus and, therefore, the matter may be placed for arbitration, learned counsel appearing on either side agreed that the matter may be resolved by means of arbitration and, this Court may, accordingly, refer the dispute for arbitration and both the parties will cooperate to complete the arbitration at the earliest.2/13 https://www.mhc.tn.gov.in/judis W.P. In view of the consent expressed by both the sides expressing their willingness to resolve the disputes before the Arbitrator, this Court is inclined to appoint a sole Arbitrator to resolve the dispute.
