The case of the petitioner is that she is the resident of Puducherry and belongs to Yadava community which is recognised as "Backward Class" in the Union Territory of Puducherry and that her parents, grand parents are all born 2 of 7 https://www.mhc.tn.gov.in/judis W.P.No.28027 of 2025and brought up in Puducherry and belong to Yadava community. On 31.07.2002, the petitioner married one V.Sree Kumar, who is hailing from Tamil Nadu and born at Kulasekaran B Village, Kalkulam Taluk, Kanyakumari District, Tamil Nadu and she belongs to Velakatalanair Community, which is classified as Most Backward Class in Tamil Nadu. According to the petitioner, after the marriage, she started matrimonial life at her parental house at No.32, Bharathi Street, Jeevanandha Puruam, Lawspet, Puducherry and out of wedlock, they are blessed with two children namely (i) S.Pratheeshmalu, now aged 22 years and (2) S.Durgadharshna, now aged 17 years, who were born on 12.05.2003 and 08.03.2008 respectively. The petitioner's children are entitled for community certificate based on mother's status and hence, the petitioner has submitted an application / representation dated 22.07.2025 before the respondents 1 and 2 for issuance of community certificate to her children based on the community status of the petitioner and since her representation did not evoke any kind of response, the petitioner has come up with the present writ petition.

The learned counsel appearing for the petitioner has relied upon an earlier order passed by this Court dated 21.12.2023 made in W.P.No.34933 of 2023, wherein this Court has dealt with a similar issue by allowing the writ petition and directed the respondents therein to issue the community certificate 3 of 7 https://www.mhc.tn.gov.in/judis W.P.No.28027 of 2025to the petitioner therein, based on the community certificate issued to the mother of the petitioner therein.
4. Heard the learned Additional Government Pleader (Puducherry) and also perused the materials available on record.
5. The facts are not in dispute. The issue is no longer res integra, as in similar facts and circumstances, this Court in W.P.No.34933 of 2023 dated 21.12.2023, has passed the following order:"
14.The order passed in the case of S.Sumathy v. Union of India represented by Secretary Revenue, Government of Puducherry and another made in W.P.No.9586 of 2014 dated 04.09.2023, is squarely applicable to the case on hand. There is no dispute regarding the fact that the mother of the writ petitioner hails from Hindu Adi Dravida origin. It is admitted fact that the petitioner's mother was a native of Puducherry and belongs to Hindu Adi Dravida "origin" community and has a valid birth certificate issued by Ariyankuppam Commune, Panchayat Puducherry.
15. Accordingly, this writ petition is allowed. The respondents are directed to issue community certificate to the petitioner that he belongs to Hindu Adi-Dravida (Origin) Schedule Caste community, within a period of four (4) weeks from the date of receipt of a copy of this order. 4 of 7 https://www.mhc.tn.gov.in/judis W.P.No.28027 of 202516. It is made clear that whenever an application is made for issuance of community certificate based on the mother's origin along with supporting documents, the Revenue Authorities shall satisfy himself on the veracity of the documents and if satisfied shall issue the certificate without driving the individual to seek for separate judicial order..."The aforesaid decision of this Court squarely applies to the facts of the present case. Considering the facts and circumstances of the case and in the light of the decision cited supra, this Court has no hesitation to allow this writ petition.
6. Accordingly, this writ petition is allowed. The respondents are directed to consider the petitioner's application dated 22.07.2025 and issue community certificate to the petitioner's children, namely S.Pratheeshmalu (Age-22) and ii) S.Durgadharshna (Age-17) indicating that they belong to "Yadava Community", which is recognised as Backward Class in Union Territory of Puducherry based on Community Certificates issued to the petitioner and other family members of the petitioner's mother, within a period of four weeks from the date of receipt of a copy of this order.

It is made clear that whenever an application is made for issuance of community certificate based on the petitioner's origin along with supporting documents, the Revenue Authorities shall satisfy themselves on the veracity of the documents and if satisfied shall issue the certificate without driving the 5 of 7 https://www.mhc.tn.gov.in/judis W.P.No.28027 of 2025individual to seek for separate judicial order. No costs. Consequently, connected miscellaneous petition is closed.
