Sittrarasu For R5ORDER(Order of the Court was made by S.M.Subramaniam J.)The final notice issued by the Assistant Director, District Town and Country Planning Office, Chengalpet District dated 22.08.2024 is under challenge in the present writ proceedings.2. The allegations of unauthorized constructions and deviations are raised 10/20 https://www.mhc.tn.gov.in/judis WP No.25974 of 2024 and CONT P No.143 of 2024against the building constructed by the writ petitioners. The issue relating to unauthorized constructions were elaborately considered by the Tamil Nadu Real Estate Regulatory Authority (TNRERA), and final order was passed on 5th November 2020 in C.No.0042015/2020. 3. The learned counsel appearing on behalf of the fifth respondent would submit that the issue was taken up before the Hon'ble Supreme Court and the order passed by the TNRERA was confirmed.4. May that as it be, this Court is of the considered opinion that the present writ petition has been filed challenging the final notice issued by the second respondent. Therefore, the petitioners have to participate in the process of enquiry to be conducted by the Assistant Director, if any and further enforcement actions are to be initiated. No writ against such notice is entertainable unless such notice has been issued by an incompetent authority having no jurisdiction or tainted with the allegations of malafide.11/20 https://www.mhc.tn.gov.in/judis WP No.25974 of 2024 and CONT P No.143 of 20245. In the present case, the issues are already decided by the TNRERA, which was confirmed by the Hon'ble Supreme Court. That being so, the petitioners are at liberty to submit their defence statement/documents before the second respondent for consideration. The second respondent is directed to take a decision by affording opportunity to the parties and proceed with all further actions including enforcement actions in accordance with law and without causing any undue delay.6. With the above observations, the writ petition stands disposed of. In view of the final order passed in the writ petition, the Contempt Petition stands closed. There shall be no order as to costs.
