O.S.No.401 of 1986 on the file of the learned Principal Subordinate Judge, Coimbatore was presented by the first respondent herein as against the appellant and his sons and daughter S.Jayakumar, C.S.Selvasrinivasakumar and the 8th respondent/petitioner C.S.Sornamugi. The suit had been decreed. The appeals preferred therefrom were dismissed. Hence the Second Appeals. 2. Pending the Second Appeal, the sole appellant C.S.Sundaram passed away on 30.09.2017. As there is none to carry forward the appeal, the daughter has filed an application to transpose herself as the appellant. She produced a https://www.mhc.tn.gov.in/judis CMP No. 493 of 2022Will dated 13.12.2004. Hence, this Court directed that the Will has to be proved. 3. The learned Principal District Judge, Coimbatore has sent a report on 21.06.2025 enclosing the findings of the learned Principal Subordinate Judge, Coimbatore dated 10.06.2025. The findings reveal that the Will has not been proved.4.It is not in dispute that Sornamugi is the daughter of the deceased Sundaram, Respondent Nos.1 and 2 are purchasers from respondent Nos.5 to 7 to whom the appellant's sons/respondent Nos.3 and 4 have alienated the property.5.I am of the view that even without the Will, the petitioner continues to be the daughter of the deceased appellant. She only represents the estate of the appellant and seeks to continue the proceedings. Hence, CMP.Nos.16670 & 16668 of 2021 stand allowed. The petitioner/8th respondent shall be transposed as the appellant.CMP.Nos.14565 & 14569 of 2021: 6. The above petitions filed to condone the delay in filing the application https://www.mhc.tn.gov.in/judis CMP No. 493 of 2022to set aside the abatement caused due to the death of the sole appellant Sundaram. 7. It is not in dispute that Sundaram had two sons namely, Jayakumar and Selvasrinivasakumar. When the legal heirs are already on record in some other capacity, the question of abatement does not arise. Hence, the question of filing applications to condone the delay in setting the abatement do not arise at all. Hence, CMP.Nos.14565 & 14569 of 2021 are absolutely unnecessary and the same are rejected.CMP.No.14567 of 2021: 8. It is not in dispute that the petitioner is the daughter of the deceased sole appellant. Her brothers are already on record as respondent Nos.3 and 4. The daughter wants to continue the proceedings in place of the father. There being no dispute in the relationship, CMP.No.14567 of 2021 stands ordered.CMP.Nos.493 & 495 of 2022: 9. The appellant has filed the above applications to bring on record the legalheirs of the deceased first respondent. It is not in dispute that the proposed party is the daughter of the deceased first respondent. Notice had been ordered in the application. The purchaser has been served. He has not entered appearance. The lis pendence purchaser might not be a strictly and a proper party for the proceedings. However, any order that need to be passed in the appeal will affect their rights.
