Broadly, the allegations in these cases relate to chain snatching incidents, all registered in June 2007, except for the case in Crl.R.C.1926 of 2023, which was registered in December 2006. In that case, the allegation is that two persons came on a two-wheeler and snatched the victim's chain. The jewels, either in full or part, are said to have been recovered from the petitioner.4. The learned counsel for the petitioner submitted that the defense's case is that the petitioner was a daily wager who, during his work, developed enmity with the Sub-Inspector of police at that time. He argued that all these cases were fabricated on the same day and that the petitioner was detained under the Goondas Act. He claims that all these cases are false.6. However, the learned Government Advocate (Crl.side) pointed out that in all these cases, there has been a recovery and, in view of the evidence available as detailed above, it cannot be said that these are foisted cases.7. The learned counsel representing the petitioner also informs this Court about the order passed in Criminal R.C.No. 240 of 2022, etc., regarding the Accused No. 1. This petitioner is accused No. 2 in the same case. It is relevant to extract paragraphs 6 and 7 of the said judgment, which read as follows:-“6. The learned counsel for the petitioner would submit that there were totally 13 cases against this petitioner and except these ten cases, he is acquitted in the 16/20 https://www.mhc.tn.gov.in/judis Crl.R.C.Nos.1925 to 1929, 1936, 1939, 1941, 1942 & 1944 of 2023other 3 cases and the petitioner hails from a respectable family background and he is not a person of bad antecedents as portrayed by the prosecution and he states that already an affidavit is filed detailing the number of days of punishment undergone by the petitioner.7. As per the said affidavit and the further instructions to the learned counsel on the either side submitted in this regard, the petitioner has so far undergone imprisonment for a period of one year and ten days as on today. Therefore, considering the said aspect, the learned counsel for the petitioner restricted his arguments as to the question of sentence alone. Considering the antecedents of the petitioner that except for the relevant period there are no other antecedents either prior to or thereafter, considering the fact that the accused has behaved properly during the period in which he was in prison and during the period in which he was out on bail and considering the age of the accused and his reformed attitude and considering the fact that of the total period of two years imposed as imprisonment and he has undergone more than 50% of the period, I am of the view that the interest of justice would be best served if the substantive punishment of imprisonment sentence alone to be modified from the period of two years to that of the period under gone in all these ten cases.”17/20 https://www.mhc.tn.gov.in/judis Crl.R.C.Nos.1925 to 1929, 1936, 1939, 1941, 1942 & 1944 of 20237. The learned counsel appearing for the petitioner further submits that, in this case as well, the petitioner has served 18 months of imprisonment, with the total sentence being 24 months. Therefore, he requests this Court to consider the question of sentence.8. The learned Government Advocate (Crl. Side) appearing for the respondent also confirms the fact about this petitioner, stating that apart from the thirteen cases mentioned above, there were no other cases against this petitioner before or after those thirteen cases. Therefore, it is evident that the petitioner has already demonstrated remorse for his conduct and has served a significant part of the punishment imposed by the Trial Court, namely, 18 months out of the two-year sentence. Since the petitioner is now said to have eking out his livelihood in a lawful manner, I am of the view, that the period already undergone is proportionate to demonstrate and make the petitioner to understand the seriousness and the consequences of his act and also would act as a deterrent to the society. Further incarceration is not necessary.9. Accordingly, these Criminal Revisions are partly allowed on the following terms:-18/20 https://www.mhc.tn.gov.in/judis Crl.R.C.Nos.1925 to 1929, 1936, 1939, 1941, 1942 & 1944 of 2023(i) The conviction of the petitioner in C.C.Nos.436, 433, 435, 439, 434, 431, 432, 429, 438 & 437 of 2008 on the file of the learned Judicial Magistrate No.I, Panruti, dated 20.12.2018, as confirmed in Crl.A.Nos.26, 23, 25, 29, 24, 21, 22, 20, 28 & 27 of 2019 on the file of the learned Principal District and Sessions Judge, Cuddalore dated 22.10.2019, is upheld;(ii) The sentence of imprisonment alone is modified as the period already undergone.(iii) The sentence relating to the fine amounts is confirmed and the submission that fine amounts are already paid is recorded.13.08.2025Neutral Citation: Yes/NonslTo1.
