The case of the petitioner is that the subject property was owned by one Nadesha Mudaliyar, who is none other than the petitioner's grandfather. During his lifetime, he settled the subject property to his elder son, namely V.N.Kothandaraman vide settlement deed dated 19.03.1966, which was registered as Document No.251 of 1996. Thereafter, he died intestate on 21.12.2012, leaving behind his wife Vasanthi, who is the 9th respondent herein, as the sole surviving legal heir. Whileso, the 9th respondent opened two term deposits for a sum of Rs.57,05,000/- and Rs.24,45,000/- each for 12 months on 31.10.2014 and Page No.3 of 8 https://www.mhc.tn.gov.in/judis W.P.No.28097 of 2025thereafter, she executed a Will dated 01.12.2014 and the same was registered as Document No.69 of 2014 in favour of the petitioner and his father. However, without serving any notice to the petitioner, the 3rd respondent has blocked the fixed deposit maintained by him with them. Aggrieved by the same, the petitioner has filed a complaint in C.C.No.165 of 2015 before the Consumer Disputes Redressal Commission, Chennai (North), which was dismissed vide order dated 17.05.2022, against which, he preferred an appeal in F.A.No.330 of 2022 before the State Commission for Consumer Disputes Redressal Commission, Chennai. Thereafter, he made a detailed representation dated 23.09.2024 requesting the respondents-bank to initiate necessary and adequate action to remit the FD amount along with the accumulated interest to his bank account maintained by him in Kotak Mahindra Bank, Valasaravakkam Branch. Upon receipt of the same, the 1st respondent, neither gone through the representation nor cross-verified with the bank rather they responded to the petitioner by way of a system-generated communication dated 01.10.2024 and closed his complaint under clause 10(2)(a)(i) of the Reserve Bank – Integrated Ombudsman Scheme, 2021. When the matter was taken up for hearing today, the learned counsel appearing for the petitioner submits that the RBI has issued a letter dated 01.10.2024, wherein it is clearly stated that in order to facilitate the petitioner's grievance and faster redress, the respondents 1 and 2 have forwarded the petitioner's complaint to the 3rd respondent-HDFC Bank for their review and response. It also stated that if the petitioner does not receive any response from the 3rd respondent within 30 days from 01.10.2024, the petitioner can very well approach the RBI Ombudsman. Hence, he submitted that recording the said letter, this writ petition may be closed and the period pending before this Court may be excluded for the purpose of implementation of the letter dated 01.10.2024 issued by the RBI.4. The learned respective counsel appearing for the respondents 1 to 8 have no serious objection for closing this writ petition based on the letter issued by the respondents 1 and 2, dated 01.10.2024.5. In view of the above, this Writ Petition is closed with a direction to the repondents 1 to 3 to comply with the letter, dated 01.10.2024 issued by the respondents 1 and 2.
