Heard the learned counsel for the petitioner and the learned Government Advocate for the first respondent and perused the materials available on record.3. The petitioner's husband was appointed as temporary driver on 05.10.1991. He was made permanent and working as a driver in the second respondent Corporation. Due to unauthorized absence, he was issued charge memo and a detailed enquiry was conducted and by an order dated 25.08.2014, he was removed from service. Thereafter, he died on 21.02.2017. After his demise, the petitioner, being his wife submitted a representation seeking terminal benefits of her deceased husband from the second respondent. It was not considered and as such, she filed a writ petition before this Court in W.P.No.9831 of 2022. This Court by an order dated 19.10.2022 directed the second respondent to consider the representation submitted by the petitioner, within a period of twelve weeks from the date of receipt of a copy of the order. After filing contest petition, the third respondent passed an order on 20.06.2023, thereby rejected the claim of the petitioner on the ground that the unimplemented punishment to the tune of Rs.1,45,135/- had been adjusted towards the gratuity and it is more than the gratuity amount. Therefore, the petitioner is liable to pay a sum of Rs.1,45,135/- to the second respondent Corporation.4. A perusal of the order of removal dated 25.08.2014 revealed that the deceased husband was served with a charge memo on 41 occasions during his service. After his demise, the petitioner simply made a representation in order to give cause of action to challenge the order of termination dated 25.08.2014. 6. Therefore, the third respondent rightly rejected the representation and this Court finds no infirmity or illegality in the order passed by the third respondent and this writ petition is devoid of merits and is liable to be dismissed.7. Accordingly, this writ petition is dismissed. Consequently, connected Miscellaneous petition is closed.
