Public Prosecutor For R1 To R7Mr.J.Pradeep, for R8 to R13ORDERThis Writ Petition has been filed to direct the respondents 1 to 7 to consider the representation of the petitioners dated 09.09.2022 and 22.02.2023 requesting to take appropriate action against the private respondents 8 to 19 for their act, activities of isolate / ostracize the petitioners from the village by committing serious offences, by conducting proper enquiry on giving opportunity of personal hearing to the petitioners consequently direct the officials respondents to pass suitable orders enabling the petitioners to live peacefully, continuously mingle with entire villagers in all manner of semanatham village, palacode taluk dharmapuri district as per time frame fixed by this hon'ble Court.2. On 24.08.2023, this Court has passed the following order:"Mr.A.Damodaran, learned Additional Public Prosecutor takes notice on behalf of the respondents 1 to 7. 2. Issue notice to the respondents 8 to 19, returnable by four weeks. Private notice is also permitted. 3. The learned Additional Public Prosecutor on instructions submitted that based on the complaint given by the petitioners, an enquiry was conducted in CSR.No.229 of 2023. 4. The learned Additional Public Prosecutor further submitted that the private respondents had given undertaking https://www.mhc.tn.gov.in/judis WP No. 24987 of 2023that they will not prevent the petitioners from having access in the village and they will not indulge in any activities resulting in ostracizing of the petitioners in the village. 5. The learned counsel for the petitioner submitted that the private respondents usually give such undertaking before the police and thereafter, they will continue to prevent the petitioners from participating in any functions or festivals and even to mingle with other villagers. 6. In the light of this submission made by the learned counsel for the petitioner, this Court does not want to close this Writ Petition for the present and hence, ordered notice to the private respondents for the purpose of getting undertaking before this Court. 7. Post this case after 4 weeks." 3. The learned counsel for the respondents 8 to 13 submitted that the respondents will not prevent the petitioners from participating in any functions or festivals and even to mingle with other villagers and given an undertaking to that effect. 4.
