Learned Standing Counsel for the respondents 2 to 4 would submit that third respondent had issued notice to the petitioner invoking Section 84(2) of the Tamil Nadu Housing Board Act, 1961, on the premise that the petitioner had encroached the land belongs to Tamil Nadu Housing Board and constructed petrol bunk in the land comprised in S.No.420/2A3 in Sholinganallur Village. Petitioner was directed to show cause.3. It is the case of the petitioner that petitioner is not the owner of the property which is mentioned in the said notice issued under Section 84(2) of the Act. https://www.mhc.tn.gov.in/judis WP No. 26254 of 2026__________Page3 of 44. Learned counsel for petitioner would submit that the subject matter of property mentioned in the impugned notice is not related to the petitioner. She would also submit that objections have also been filed by the petitioner.
The said submission was disagreed to by the learned Standing Counsel for the Housing Board and he would submit that petitioner has not responded to the notice issued under Section 84(2) of the Act.6. In the said circumstances, this Writ Petition is disposed of by granting liberty to the petitioner to submit his reply / objection, in case it has not been submitted so far to the notice dated 24.06.2026 issued under Section 84(2) of the Act. If any such reply / objection is made already, it is open to the petitioner to file an additional reply / objection within a period of two weeks from the date of uploading of web copy without waiting for receipt of certified copy of the order. Upon filing of such reply / objection, the third respondent shall proceed to pass orders in accordance with law. It is made clear that until the above process is over, the respondents shall not take any coercive proceedings. No costs.
