In the considered view of this Court, the issue brought up in these petitions pertains to individual dispute between the parties. Learned Senior Counsel appearing on behalf of the petitioner submitted that if the petitioner was aware that criminal proceedings are initiated against him, the petitioner would not have signed in the affidavit and in the Memorandum of Understanding.4. In the considered view of this Court the individual dispute between the parties cannot be a ground to modify the earlier order passed by this Court. If these petitions are entertained and heard, it will go beyond the scope of the earlier order, which was passed based on the Memorandum of Understanding between the parties. If, according to the petitioner, there is abuse of process of law, it has to be challenged separately and it cannot form part of the present proceedings where the order was passed based on the Memorandum of Understanding between the parties.
