The case of the petitioners is that the petitioners are the members of Tamil Nadu State Transport Corporation Retired Administrative and Technical Supervisory Staff Welfare Association (Reg.No.19/2011), Salem West, have completed 10 years of service in the Tamil Nadu State Transport Department. As mandated vide G.O.Ms.No.378 (FR II) dated 18.04.1975, petitioners are eligible for pension from the first respondent State Government. While that 11/18 https://www.mhc.tn.gov.in/judis WP No. 26410 of 2023being so, one Mr.G.Shanmugam, a similarly situated pensioner as that of petitioners, retired from service on 31.12.1998 and the respondents have given all terminal benefits and other benefits which he is entitled to without any recovery. Similarly, petitioners also ought to have received all the benefits on par with Mr.G.Shanmugam, however, the same was not considered in respect of petitioners. Therefore, the petitioners made representations before the respondents 1 to 4 on various dates and the same were pending without any progress. Hence, the petitioners have filed the instant Writ Petition seeking suitable relief.3. Learned counsel for the petitioner would submit that respondents 1 and 4 have received the representation of the petitioners dated 15.03.2023, 17.03.2023, 20.03.2023, 21.03.2023, 23.03.2023, 24.03.2023, 27.03.2023, 28.03.2023, 29.03.2023, 30.03.2023, 31.03.2023, 03.07.2023, 04.07.2023 and 05.07.2023 and have not passed any orders on the same. It is further submitted that it would be suffice, if a direction is issued to respondents to consider the petitioner's representation and pass orders within a time frame fixed by this 12/18 https://www.mhc.tn.gov.in/judis WP No. 26410 of 2023Court.4. Learned counsel for the respondent filed counter and submitted that according to the TNSTC Employees Pension Fund Trust Rules, petitioners are not entitled to pension as claimed by the them. It is further submitted that as per Rule 14(b) under Part VI pensionary benefits, if a member is eligible for pension under any other scheme, gross pension payable under the scheme shall be calculated notionally by including the period of pensionable service rendered with the previous employer and the total eligible service shall be restricted to 30 years. The difference between the gross pension and the amount already received by the individual for the service rendered with the previous employer or the pension eligible under the scheme whichever is less shall be the eligible pension under the scheme. Having not satisfied with the above rules, petitioners preferred Writ Petition in W.P.No.7715 of 2023 and the same is pending before the Hon'ble Division Bench. Learned counsel for the respondents further submitted that as per the existing rules, they will consider the representation of the petitioners and will pass appropriate orders in the manner known to law 13/18 https://www.mhc.tn.gov.in/judis WP No. 26410 of 2023within a stipulated time.5. Heard both sides and perused the material available on record.6. In view of the submissions made by the learned counsel for the petitioner and the learned counsel for the respondents, this Court without expressing any opinion on the merits of the case, directs the respondents to consider representations of the petitioners dated 15.03.2023, 17.03.2023, 20.03.2023, 21.03.2023, 23.03.2023, 24.03.2023, 27.03.2023, 28.03.2023, 29.03.2023, 30.03.2023, 31.03.2023, 03.07.2023, 04.07.2023 and 05.07.2023 and pass appropriate order in the manner known to law, preferably within a period of twelve weeks from the date of receipt of copy of this order.7.
