The present writ petition is filed praying for a writ of mandamus to direct the respondents 1 to 5 to survey the land and issue sub division patta on the basis of petitioner's online application No.2025/0105/06/577082 dated 24.02.2025 and on the basis of sale deeds registered in Document No.72/1981 dated 07.01.1981, Document No.246/1981 dated 04.02.1981 and Document No.409/1986 dated 02.01.1986 situated at Kaniyampoondi Village, Kilpennathur Taluk, Tiruvannamalai District and make necessary entries in the revenue records and further direct the respondents 1 to 5 consider the petitioner's representation letter dated 29.03.2025 in accordance with law and further direct the 6th respondent to provide adequate police protection at the time of survey. 3. It is submitted by the learned counsel for the petitioner that the petitioner and his brother purchased the property comprised in Survey Nos.44/4, 44/3 and 45/3 measuring an extent of 2 acre 91 cents situated at Kaniyampoondi Village, Kilpennathur Taluk, Tiruvannamalai District vide above mentioned registered sale deeds and a joint patta came to be issued in the name of the petitioner and his brother in Patta No.110. It is stated that the said joint patta only shows 2 acres and 8 cents though the petitioner owns 2 acres and 91 cents in terms of the above sale deeds. It is further stated that the remaining 0.83 cents have been shown in another patta viz. Patta No.246 issued to the adjacent land 3/8 https://www.mhc.tn.gov.in/judis W.P. No.25465 of 2025owners. The above error apparently crept in during computerization of the revenue records. Hence, the petitioner submitted representations/applications dated 02.06.2015, 22.08.2016, 04.10.2017, 01.03.2019, 26.02.2021, 01.01.2024, 31.01.2024 and 12.02.2024 before the official respondents seeking survey and issuance of sub division of patta in respect of property and paid necessary fees. However, the said applications/representations were not considered. Hence, the petitioner again submitted an online application dated 24.02.2025 seeking survey and issuance of sub division of patta and paid necessary fees and the same was not considered. Thereafter, the petitioner again submitted a representation dated 29.03.2025 before the respondents seeking survey and sub division of patta. However, the said representation has not been considered so far. Hence, the petitioner has filed the present writ petition.4. At the outset, it is submitted by Mr.Balamurugan, learned Government Advocate for the respondents 1 to 5 that the above applications/representations 24.02.2025 and 29.03.2025 submitted by the petitioner would be considered and appropriate orders would be passed within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner. 4/8 https://www.mhc.tn.gov.in/judis W.P. No.25465 of 20255. It is further submitted by the learned Government Advocate that in case police protection is required they would request the sixth respondent. When this was pointed out, the learned Government Advocate, Mr.R.Kishore Kumar appearing for the sixth respondent would submit that if any such request is made adequate police protection will be granted. 6. In view thereof, there shall be a direction to the respondent Nos.1 to 5 to consider petitioner's application dated 24.02.2024 and representation dated 29.03.2025 and carry out a survey in the subject property and complete the process within a period of 8 weeks from the date of uploading of the web copy without waiting for the receipt of certified copy giving prior notice to the petitioners, adjacent land owners and other interested parties including rival claimants if any. If any such request is made by the respondents 1 to 5, the 6th respondent is directed to provide adequate police protection for conducting the survey. 7. As regards issuance of sub division of patta, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the respondent Nos.1 to 5, to consider the application dated 24.02.2024 and representation dated 29.03.2025, seeking 5/8 https://www.mhc.tn.gov.in/judis W.P. No.25465 of 2025sub division of patta, on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioners and any other interested persons/stake holders, within a period of twelve (12) weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. 8. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law. 9. Accordingly, the writ petition stands disposed of.
