There is a dispute between the Vadakalai and Thenkalai sects of Vaishnavaits. The facts of the case is that the Thenkalai Sect takes out the deity of manavala mamunigal in a procession and start chanting Divya Prabandhams, after lighting camphor in frount of the temple. The vadakalai Sect wanted to close the doors of the main entrance to the temple at that time. By the order impugned in the writ petition, the HR & CE 5 https://www.mhc.tn.gov.in/judis Commissioner refused permission to the temple to close the doors near the entrance to the temple. 3. When the matters are taken up for hearing, the learned counsel for the petitioner submitted that this Court, without going into the merits of the case, remanded the mater bank to the Joint Commissioner, HR & CE and permit the petitioners to canvass all the points before him in the manner known to law. 4. In this regard, the learned counsel for the respondents and impleaded respondents have also not objected. 5. Heard, the learned counsel for the petitioners, the learned counsel appearing for the respondents and perused the materials available on record. 6. In view of the limited request sought for by the petitioners, this Court without going into the merits of the case and without express any 6 https://www.mhc.tn.gov.in/judis opinion on the merits of the case, sets aside the impugned order passed by the Commissioner, HR & CE Department dated 29.09.2014 and remands the matter back to the Joint Commissioner, HR & CE, Cuddalore to decide the issue between the parties in terms of Section 63 of HR & CE Act and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order, after providing opportunity to the petitioner and the respondents, in accordance with law. The interim order passed by this Court dated 17.10.2014, in W.P.Nos.27698 to 27700 and 27918 of 2014 shall continue, till the disposal of the proceedings. 7. These writ petitions are disposed of with the above directions. There shall be no order as to costs.
