Writ Petition No.15230 of 2014respondent 1 to 3 to place the petitioner in the pay scale of Rs.9300 – 34800 + 4,400 w.e.f. 01.01.2007 as per the 1st respondent's letter No.63305/Pay Cell/ 2010 – 1 dated 08.11.2010 and consequently pay the terminal benefits and other attendant benefits accordingly.For Petitioner:Mr.B.RaviFor Respondents:Mr.C.JayaprakashR1 to R3Government AdvocateR4:Mr.RaghavanO R D E RThis writ petition is filed with a prayer to issue a writ of Certiorarified Mandamus calling for records pertaining to the proceedings in O.Mu.No.1024/E2/2014 dated 26.03.2014 issued by the 3rd respondent, quash the same and direct the respondent Nos. 1 to 3 to place the petitioner in the pay scale of Rs.9300 – 34800 + 4,400 w.e.f. 01.01.2007 as per the 1st respondent's letter No.63305/Pay Cell/ 2010 – 1 dated 08.11.2010 and consequently pay the terminal benefits and other attendant benefits accordingly.2. The facts of this case are that the Petitioner/V.Raman, joined the services of the 4th respondent/Sri Saradha College for Women on 03.12.1976 as Junior Mechanic. He was having required qualifications for the said post at the relevant point of time. Accordingly salary was fixed in the pay scale of 555-15-615-20-795-25-970 and the same was 2/14 https://www.mhc.tn.gov.in/judis Writ Petition No.15230 of 2014revised as per G.O.Ms.No.527 dated 01.08.1992 and his pay was raised 950-1500. The petitioner was subsequently given selection grade in the pay scale of 1200-2040 on 03.12.1986, and was givne Special Grade in the scale of pay of 1320-2040 with effect from 03.12.1996. 3. In the month of June 2009, the 1st respondent decided to implement the recommendations of the VII Pay Commission with effect from 01.01.2006 with arrears payable from 01.01.2007. The petitioner was placed under PB1 Rs. 5,200 – 20,000 + 2,600 GP. The fixation pay was referred to One Man Commission by the Government to remove the certain anamolies. In the meanwhile, the petitioner retired from service on 31.05.2010. One Man Commission recommendations were accepted by the Government and issued proceedings dated 08.11.2010 vide letter No.6305/Pay Cell/ 2010- 1 reviving the pay of PB1 Rs.5,200 – 20,200 + 2,600 GP was revies to Rs.9,300 – 34800 + 4,400. However pay of the petitioner was not revised from Rs.5200 – 9300. The petitioner made several representations inspite of that there was no response and finally the 3rd respondent has rejected the request of the petitioner by way of the impugned order dated 26.03.2014 directing the petitioner to get orders from the Court. 4. The 2nd respondent has filed counter affidavit and additional 3/14 https://www.mhc.tn.gov.in/judis Writ Petition No.15230 of 2014counter affidavit to which a reply affidavit has been filed by the petitioner. The counter affidavit filed by the 2nd respondent states that the petitioner joined as Junior Mechanic in the 4th respondent. His educational qualification are 10th fail in the old SSLC pattern and ITI (Fitter) passed. Further by virute of his service he was moved to Selection Grade in pay scale of 1200-30-1560-40-2040 and Special Grade of pay of Rs.1320-30-1560-40-2040. It is mentioned in the counter-affidavit that the petitioner gave a request to the 3rd respondent herien on 17.02.2014 to revise his pay on par with Mechanic Grade I as per the Government letter No.63305/Pay Cell/2010 – 1 dated 08.11.2010 issued by the Finance ( Pay Cell) Department, which was rejected by the 3rd respondent in his proceedings Oo.Mu.No.1024/E2/2014 dated 26.03.2014. In the counter affidavit it is further stated that the petitioner does not fulfil the requisite educational qualification prescribed in G.O.Ms.No.1704, Education dated 21.12.1990 that is SSLC passed or its equivalent a) National Trade Certificate either in Electrician Trade or in Mechanist Trade with 3 years experience in operation of Electricial Generator, Electricial Motors and Pump sets, knowledge of servicing electronic and Electricial instruments such as CRO vaccum tube, voltmeter, projector, amplifier, pumping and minor carpentary. b) National Apprenticeship course Certificate either in electrician Trade or Electronic Mechanic Trade with 2 years experience of operation and maintenance of Electricial Generator, Electronic Motors and Pump sets, knowledge of servicing Electronic and Electricial instruments such as CRO, Vaccum tube, Voltmeter, Projector, Amplifier, Pumping and minor carpentary. It is further mentioned that the rejection of the 2nd respondent is legally valid and that there is no illegality in issuing Oo.Mu.No.1024/E2/2014 dated 26.03.2014, as the petitioner has claimed the scale of pay of Rs.9300-34800 + 4400 GP without satisfying the prescribed qualifications.5/14 https://www.mhc.tn.gov.in/judis Writ Petition No.15230 of 20146. The Additional Counter Affidavit filed by the 2nd respondent states that the Head Master, Arunachalam Corporation High School, Sagadevapuram, Salem – 600 007 issued a letter in No.23/A1/2000 dated 09.02.2000 stating that the petitioner was not qualifed 10th Std, and was not issued with a mark sheet by the School Authorities. 7. On the basis of Government Order a Mechanic working in Government Colleges with SSLC failed are admitted at Rs.555-970 scales of pay in ordinary grade and Rs.610-1075 for selection grade pay. But the petitioner did not pass the SSLC qualification until his retirement on superannuation, thereby the petitioner is not eligible for revision of pay as per Go.Ms.No.762 dated 20.08.1986. The Government also revised pay scales to certain categories based on the recommendation of the Official Committee, in Go.Ms.No.527 Finance (Pay Cell) Department dated 01.08.1992. Accordingly, the pay of the petitioner also refixed with Selection Grade in Junior Mechanic Category with effect from 8/14 https://www.mhc.tn.gov.in/judis Writ Petition No.15230 of 201402.10.1988 and monetary benefit with effect from 01.04.1992 as Rs.1230/- in the scale of pay of Rs.1200-2040 as per the Government Order and approved by the Regional Joint Director in pay scale of Rs.1320-2040 and the pay to the petitioner as Rs.1500/- with effect from 03.12.1996. The pay scale of the Government Servants are revised with effect from 01.01.2006 and monetary benefit with effect from 01.01.2007 in Go.Ms.No.234 Finance Department dated 01.06.2009 on the basis of which the pay of the petitioner was revised as Rs.5200-20200 with grade pay of Rs.2600/- by the Regional Joint Director of Collegiate Education. As the petitioner completed 30 years of service as on 01.12.2006 and superannuated on 31.05.2010, he was allowed with bonus increment of Rs.410/- and his last pay drawn was Rs.14,890/-. 11. As per Go.Ms.No.1874 (Education) dated 30.10.1974, the qualification required for appointment as Junior Mechanic is 8th Standard with ITI as basic qualification which the petitioner possessed. His scale of pay was revised with effect from 01.01.2006 and monetary benefits with effect from 01.01.2007 in accordance with Go.Ms.No.234 (Finance Department) dated 01.06.2009, and that his pay scale was also revised to Rs.5200 – 20200 with grade pay of Rs.2600 and it was further revised to 9/14 https://www.mhc.tn.gov.in/judis Writ Petition No.15230 of 2014Rs.9300 – 34800 with grade pay of Rs.4400. However requisite basic qualification was changed to SSLC Pass only with effect from 27.11.1984, whereas the petitioner was recruited on 03.12.1976 when the basic qualification required was 8th standard/III Form. And no GO was issued directing that existing staff members to upgrade their qualification from 8th standard to SSLC. On the other hand the GO.No.1221 dated 11.10.1985 granted exemption to existing staff members by extending protection of their employment.12. After accepting the VIIth pay commission report, the respondent No.1 has decided to implement the same and accordingly the pay of the petitioner was fixed at PB1 at Rs.5,200 – 20200 + 2600 GP, as per the proceedings the Accounts Officer of Joint Director Collegiate Education in the month of August 19.08.2009. One man commission was appointed for removal of certain anamolies in the pay fixation. The Government has issued directions through letter No.663 of 2005 asking to implement one man commission recommendations. However, insofar as petitioner is concerned, proceedings were issued stating that the petitioner has to get the directions from the Court, only thereafter the pay scale of the petitioner will be revised.13. This observation of the Joint Director of Collegiate Education 10/14 https://www.mhc.tn.gov.in/judis Writ Petition No.15230 of 2014in the impugned order his highly objectionable. The Joint Director of Collegiate Education being responsible officer is expected to inform the petitioner as to whether the petitioner is entitled for revision of his pay as per the recommendations of the one man commission or if not he is expected to inform as to why the petitioner is not entitled for the revision. However, Joint Director of Collegiate Education has simply thrown the burden on this Court by issuing the proceedings stating that the petitioner has to get directions from this Court. It is unfortunate the Joint Director of Collegiate Education has failed to responsibly discharge his duties in not revising the salaray of the petitioner. The impugned order of the Joint Director of Collegiate Education in O.Mu.No.1024/E2/2014 dated 26.03.2014 is erroneous, therefore, is liable to be set aside.14.
